PAG LIN 1 1 Section 1. Section 252H.12, subsection 2, Code 1997, is 1 2 amended to read as follows: 1 3 2. The support order provides for the ongoing support of 1 4 at least one child under the age of eighteen or a child 1 5between the ages of eighteen and nineteenthrough twenty-two 1 6 years of age who has not yet graduated from high schoolbut1 7 due to academic reasons, illness, disability, or other 1 8 circumstances, who isreasonably expected to graduate from1 9 engaged full-time in completing high schoolbefore attaining1 10the age of nineteengraduation or equivalency requirements. 1 11 Sec. 2. Section 252H.22, subsection 2, Code Supplement 1 12 1997, is amended to read as follows: 1 13 2. The support order provides for the ongoing support of 1 14 at least one child under the age of eighteen or a child 1 15between the ages of eighteen and nineteenthrough twenty-two 1 16 years of age who has not yet graduated from high schoolbut1 17 due to academic reasons, illness, disability, or other 1 18 circumstances, who isreasonably expected to graduate from1 19 engaged full-time in completing high schoolbefore attaining1 20the age of nineteengraduation or equivalency requirements. 1 21 Sec. 3. Section 598.1, subsection 9, Code Supplement 1997, 1 22 is amended to read as follows: 1 23 9. "Support" or "support payments" means an amount which 1 24 the court may require either of the parties to pay under a 1 25 temporary order or a final judgment or decree, and may include 1 26 alimony, child support, maintenance, and any other term used 1 27 to describe these obligations. For orders entered on or after 1 28 July 1, 1990, unless the court specifically orders otherwise, 1 29 medical support is not included in the monetary amount of 1 30 child support. The obligations shall include support for a 1 31 childwho is between the ages of eighteen and nineteenthrough 1 32 twenty-two yearswhoof age who has not yet graduated from 1 33 high school due to academic reasons, illness, disability, or 1 34 other circumstances if the child is engaged full-time in 1 35 completing high school graduation or equivalency requirements 2 1in a manner which is reasonably expected to result in2 2completion of the requirements prior to the person reaching2 3nineteen years of age;and may include support for a child of 2 4 any age who is dependent on the parties to the dissolution 2 5 proceedings because of physical or mental disability. 2 6 EXPLANATION 2 7 This bill provides that child support shall be provided to 2 8 a child through 22 years of age if the child has not graduated 2 9 from high school due to certain circumstances but is engaged 2 10 full-time in completing high school graduation or equivalency 2 11 requirements. The bill eliminates current language which 2 12 requires that the graduation or equivalency requirements be 2 13 reasonably expected to be completed prior to the child 2 14 reaching 19 years of age, thereby allowing the child to 2 15 complete the requirements through the child's 22nd year. The 2 16 bill also makes conforming changes in the chapter of the Code 2 17 relating to review and adjustment of child support orders. 2 18 LSB 3423HH 77 2 19 pf/sc/14
