PAG LIN 20 HOUSE FILE 717 22 24 MARGINS C 26 AN ACT 28 MARGINS F 30 TO LEGALIZE THE PROCEEDINGS TAKEN BY THE SERGEANT BLUFF CITY 32 COUNCIL TO GRANT AN URBAN REVITALIZATION TAX EXEMPTION FOR 34 CERTAIN PROPERTY AND PROVIDING AN EFFECTIVE AND RETROACTIVE 36 APPLICABILITY DATE. 82 WHEREAS, the city of Sergeant Bluff decided in February of 90 1996 to designate a portion of the city as an urban 100 revitalization area under chapter 404; and 110 WHEREAS, Sioux City Brick and Tile held a groundbreaking 120 ceremony on April 11, 1996, and began construction on property 130 within the urban revitalization area on August 1, 1996; and 140 WHEREAS, the Sergeant Bluff city council adopted, on December 150 17, 1996, a resolution in accordance with section 404.2 stating 160 the necessity for establishing the urban revitalization area in 170 which property owned by Sioux City Brick and Tile would be 180 eligible for the urban revitalization property tax exemption; and 190 WHEREAS, the Sergeant Bluff city council held a public hearing 200 on the proposed urban revitalization area and adopted the plan 210 for the revitalization area in accordance with section 404.2 on 220 January 28, 1997; and 230 WHEREAS, the Sergeant Bluff city council erroneously believed 240 that the Sioux City Brick and Tile property would be qualified 250 for the urban revitalization tax exemption as of January 28, 260 1997, even though construction was completed prior to that date; 270 and 280 WHEREAS, section 404.3, subsection 7, requires the 290 construction to be undertaken during the period in which the 300 property was in a designated urban revitalization area; NOW 310 THEREFORE, 330 332 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: 340 342 MARGINS L 380 Section 1. All proceedings taken by the Sergeant Bluff 390 city council regarding the adoption of the urban 400 revitalization plan are hereby legalized and constitute a 410 valid adoption of an urban revitalization plan. 420 Sec. 2. This Act, being deemed of immediate importance, 430 takes effect upon enactment and is retroactively applicable on 440 and after April 1, 1996. 620 630 640 650 RON J.
