1 1 Section 1. NEW SECTION. 309.4 REGULATION OF ACTIVITIES
1 2 ALONG ROADWAYS.
1 3 A county may regulate burning, brush clearing, and other
1 4 uses of the rights-of-way of streets or highways under the
1 5 jurisdiction of the county by persons other than the state, to
1 6 the extent that the regulation does not conflict with a
1 7 provision of chapter 321.
1 8 However, the board of supervisors shall not impose
1 9 standards which conflict with the standards adopted by the
1 10 utilities board pursuant to chapter 390, 474, 476, 476A, 477,
1 11 478, 479, 479A, or 480, with other authority which has been
1 12 granted to utilities to place lines, cables, and physical
1 13 plants within secondary road rights-of-way, or with rules of
1 14 the department of natural resources relating to hunting,
1 15 trapping, or fishing on secondary road rights-of-way.
1 16 EXPLANATION
1 17 This bill provides that a county may regulate burning,
1 18 brush clearing, and other uses of the rights-of-way of streets
1 19 or highways under the jurisdiction of the county by persons
1 20 other than the state, to the extent that the regulation does
1 21 not conflict with a provision of the utilities board, other
1 22 authority granted to utilities, or a provision regarding
1 23 hunting, trapping, or fishing adopted by the department of
1 24 natural resources.
