  1  1    Section 1.  Section 455B.310, Code 1997, is amended by
  1  2 adding the following new subsection:
  1  3    NEW SUBSECTION.  8.  An operator of a sanitary landfill who
  1  4 is required to pay a tonnage fee under this section shall
  1  5 receive refunds as follows:
  1  6    a.  A refund of fifty cents for establishing and operating
  1  7 a curbside recycling program for residences or businesses.
  1  8    b.  A refund of twenty-five cents for establishing and
  1  9 operating areas or facilities for a drop-off recycling
  1 10 program.
  1 11    c.  A refund of twenty-five cents for establishing and
  1 12 operating regional centers for the collection and disposal of
  1 13 household hazardous material, as defined in section 455F.1.
  1 14    d.  A refund of twenty-five cents for establishing and
  1 15 operating an annual toxic cleanup day program for the
  1 16 collection and disposal of household hazardous material, as
  1 17 defined in section 455F.1.
  1 18    e.  A refund of twenty-five cents for establishing and
  1 19 operating community communication programs or activities
  1 20 including speakers bureaus, informational brochures, school
  1 21 programs, media relations, and advertising to increase
  1 22 awareness of the methods of waste volume reduction at the
  1 23 source and recycling.
  1 24    f.  A refund of twenty-five cents for sanitary landfill
  1 25 operators who have established subtitle D liners as defined in
  1 26 40 C.F.R. pt. 258, subpt. D, and are in compliance with all
  1 27 federal requirements regarding the construction and operation
  1 28 of new sanitary landfills pursuant to 40 C.F.R. pt. 258.
  1 29    g.  A refund of twenty-five cents for establishing and
  1 30 operating a community host fee program in which the operator
  1 31 of a sanitary landfill voluntarily pays an annual fee or
  1 32 property tax to the community in which it has located a
  1 33 facility such as a landfill, a composting center, a transfer
  1 34 station, or a regional collection center.
  1 35    h.  A refund of ten cents for establishing and operating a
  2  1 program for community cleanup grants which allow communities
  2  2 within the planning area to receive grants for the collection
  2  3 or disposal of waste collected during annual neighborhood
  2  4 cleanup events or partnerships that are aimed at diverting
  2  5 household hazardous material away from landfills.
  2  6    i.  A refund of ten cents for establishing and operating a
  2  7 scrap tire program which allows the deposit of scrap tires at
  2  8 a designated location for processing or disposal at a
  2  9 landfill.
  2 10    j.  A refund of ten cents for establishing and operating a
  2 11 sharps program for the collection and disposal of used
  2 12 hypodermic needles.
  2 13    Sec. 2.  Section 455D.3, subsection 4, paragraph a, Code
  2 14 1997, is amended to read as follows:
  2 15    a.  Remit fifty cents per ton to the department, as of July
  2 16 1, 1995.  The funds shall be deposited in the solid waste
  2 17 account under section 455E.11, subsection 2, paragraph "a", to
  2 18 be used for funding alternatives to landfills pursuant to
  2 19 section 455E.11, subsection 2, paragraph "a", subparagraph
  2 20 (1).  Moneys under this paragraph shall be remitted until such
  2 21 time as evidence of attainment of the twenty-five percent goal
  2 22 is documented in subsequent comprehensive plans submitted to
  2 23 the department.  However, an operator of a landfill which has
  2 24 established and is operating a curbside recycling program for
  2 25 residences and businesses shall not be subject to the penalty
  2 26 imposed under this paragraph beginning July 1, 1997, and
  2 27 ending June 30, 1999.
  2 28    Sec. 3.  Section 455D.3, subsection 4, paragraph c, Code
  2 29 1997, is amended to read as follows:
  2 30    c.  Develop draft ordinances which shall may be voluntarily
  2 31 used by local governments for establishing collection fees
  2 32 that are based on volume or on the number of containers used
  2 33 for disposal by residents.  
  2 34                           EXPLANATION
  2 35    This bill provides for a number of specified refunds on
  3  1 tonnage fees paid by operators of sanitary landfills.  Under
  3  2 Code section 455B.310, an operator of a sanitary landfill
  3  3 shall pay a tonnage fee for each ton of solid waste received
  3  4 and disposed of at the sanitary landfill.  The bill provides a
  3  5 refund for any of the following activities:
  3  6    1.  A refund of 50 cents for establishing and operating a
  3  7 curbside recycling program.
  3  8    2.  A refund of 25 cents for establishing and operating a
  3  9 drop-off recycling program.
  3 10    3.  A refund of 25 cents for establishing and operating
  3 11 regional centers for the collection and disposal of household
  3 12 hazardous material.
  3 13    4.  A refund of 25 cents for establishing and operating a
  3 14 toxic cleanup day program for the collection and disposal of
  3 15 household hazardous material.
  3 16    5.  A refund of 25 cents for establishing and operating
  3 17 community communication programs or activities.
  3 18    6.  A refund of 25 cents for establishing subtitle D liners
  3 19 and complying with all federal requirements regarding the
  3 20 construction and operation of new sanitary landfills.
  3 21    7.  A refund of 25 cents for establishing and operating a
  3 22 community host fee program where the operator of a sanitary
  3 23 landfill voluntarily pays an annual fee or property tax to a
  3 24 community in which it has located a facility like a landfill,
  3 25 composting center, transfer station, or regional collection
  3 26 center.
  3 27    8.  A refund of 10 cents for establishing and operating a
  3 28 program for community cleanup grants for the collection or
  3 29 disposal of waste collected during annual neighborhood cleanup
  3 30 events or partnerships that are aimed at diverting household
  3 31 hazardous material away from landfills.
  3 32    9.  A refund of 10 cents for establishing and operating a
  3 33 scrap tire program for the collection of scrap tires.
  3 34    10.  A refund of 10 cents for establishing and operating a
  3 35 sharps program for the collection and disposal of used
  4  1 hypodermic needles.
  4  2    Currently, when a planning area fails to meet the 25
  4  3 percent waste stream reduction goal, the planning area is
  4  4 required to remit $.50 per ton to the department until
  4  5 attainment of the goal is achieved.  The bill provides that a
  4  6 landfill operator shall not be required to pay the $.50 per
  4  7 ton between July 1, 1997, and June 30, 1999, if the landfill
  4  8 operator has established and is operating a curbside recycling
  4  9 program for residences and businesses.
  4 10    The bill provides that when a planning area fails to meet
  4 11 the 25 percent waste stream reduction goal, the planning area
  4 12 shall develop draft ordinances which may be voluntarily used
  4 13 by local governments for establishing collection fees that are
  4 14 based on volume or on the number of containers used for
  4 15 disposal by residents.  Currently, local governments are
  4 16 required to use the draft ordinances.
