  1  1    Section 1.  Section 455D.13, Code 1997, is amended to read
  1  2 as follows:
  1  3    455D.13  LAND DISPOSAL OF WASTE OIL AND OIL FILTERS
  1  4 PROHIBITED – COLLECTION.
  1  5    1.  A sanitary landfill shall not accept waste oil or oil
  1  6 filters for final disposal beginning July 1, 1990.
  1  7    2.  A person offering for sale or selling oil or oil
  1  8 filters at retail in the state shall do the following:
  1  9    a.  Accept at the point of sale, waste oil or oil filters
  1 10 from customers, or post notice of locations where a customer
  1 11 may dispose of waste oil or oil filters.
  1 12    b.  Post written notice that it is unlawful to dispose of
  1 13 waste oil and oil filters in a sanitary landfill.
  1 14    Sec. 2.  NEW SECTION.  455D.13A  WASTE OIL FILTER
  1 15 RECYCLING.
  1 16    1.  A person collecting waste oil filters shall post
  1 17 written notice identifying all waste oil filter recyclers
  1 18 servicing that collection site.  Upon collection by a recycler
  1 19 of waste oil filters from a collection site, the recycler
  1 20 shall provide the collection site with a receipt which shall
  1 21 include a statement identifying all end users of the recycled
  1 22 oil filters.
  1 23    2.  All waste oil filter recyclers collecting waste oil
  1 24 filters from a collection site in the state shall report
  1 25 annually to the department identifying all end users of the
  1 26 recycled oil filters.  
  1 27                           EXPLANATION
  1 28    This bill prohibits the disposal of oil filters in sanitary
  1 29 landfills.  The bill creates the same requirements for a
  1 30 person who sells oil filters as a person who sells oil
  1 31 regarding the collection of waste oil and oil filters and
  1 32 notice requirements.
  1 33    The bill provides that a person collecting waste oil
  1 34 filters shall post notice identifying the recycler servicing
  1 35 the collection site.  The bill requires that a recycler
  2  1 provide the collection site with a receipt identifying all end
  2  2 users of the recycled oil filters.  The bill provides that
  2  3 recyclers shall report annually to the department of natural
  2  4 resources identifying all end users.
