  1  4 TO INCREASE THE PENALTIES FOR THE MANUFACTURE, DELIVERY,
  1  5    OR POSSESSION WITH INTENT TO MANUFACTURE OR DELIVER
  1  6    AMPHETAMINE OR ANY SUBSTANCE CONTAINING AMPHETAMINE.

  1  8 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

  1 10    Section 1.  Section 124.401, subsection 1, paragraph a,
  1 11 subparagraph (2), subparagraph subdivision (e), Code 1997, is
  1 12 amended to read as follows:
  1 13    (e)  Amphetamine, its salts, isomers, and salts of isomers.
  1 14    (e) (f)  Any compound, mixture, or preparation which
  1 15 contains any quantity of any of the substances referred to in
  1 16 subparagraph subdivisions (a) through (d) (e).
  1 17    Sec. 2.  Section 124.401, subsection 1, paragraph b, Code
  1 18 1997, is amended by adding the following new subparagraph:
  1 19    NEW SUBPARAGRAPH.  (8)  More than five grams but not more
  1 20 than five kilograms of amphetamine, its salts, isomers, or
  1 21 salts of isomers, or any compound, mixture, or preparation
  1 22 which contains any quantity of detectable amount of
  1 23 amphetamine, its salts, isomers, and salts of isomers.
  1 24    Sec. 3.  Section 124.401, subsection 1, paragraph c, Code
  1 25 1997, is amended by adding the following new subparagraph (7)
  1 26 and renumbering the subsequent subparagraph:
  1 27    NEW SUBPARAGRAPH.  (7)  Five grams or less of amphetamine,
  1 28 its salts, isomers, or salts of isomers, or any compound,
  1 29 mixture, or preparation which contains any quantity or
  1 30 detectable amount of amphetamine, its salts, isomers, and
  1 31 salts of isomers.
