  1  1    Section 1.  Section 279.8, Code 1997, is amended to read as
  1  2 follows:
  1  3    279.8  GENERAL RULES – BONDS OF EMPLOYEES.
  1  4    1.  The board of directors of each school district shall
  1  5 make adopt rules for its own government and that of the
  1  6 directors, officers, employees, teachers and pupils, and for
  1  7 the care of the schoolhouse, grounds, and property of the
  1  8 school corporation, and shall aid in the enforcement of the
  1  9 rules, and require the performance of duties imposed by law
  1 10 and the rules.
  1 11    2.  The board shall include in its rules provisions the
  1 12 following:
  1 13    a.  Provisions regulating the loading and unloading of
  1 14 pupils from a school bus stopped on the highway during a
  1 15 period of reduced highway visibility caused by fog, snow or
  1 16 other weather conditions.
  1 17    b.  Provisions governing the handling of complaints from
  1 18 students, parents, staff, administrators, or other persons
  1 19 against an employee of the district, which result from an
  1 20 alleged act or omission occurring within the course of the
  1 21 employee's employment.  These rules shall contain requirements
  1 22 that, at a minimum, indicate all of the following:
  1 23    (1)  The complaint shall be in writing and signed by the
  1 24 complaining party.
  1 25    (2)  The employee shall receive a copy of the complaint and
  1 26 shall have an opportunity to respond.  The employee's response
  1 27 shall be given appropriate weight.
  1 28    (3)  All parties to the complaint shall be notified in
  1 29 writing of any resolution of the complaint.
  1 30    (4)  A party to the complaint may file with the board a
  1 31 request for a review of the resolution of the complaint.
  1 32    (5)  All verbal or written information relating to the
  1 33 subject matter of a complaint is a confidential communication
  1 34 and shall be kept confidential by all persons involved in the
  1 35 complaint process of the complaint.
  2  1    (6)  Pending resolution, the board's action shall
  2  2 constitute final board action.
  2  3    3.  The board shall have the authority to include in its
  2  4 rules provisions allowing school corporation employees to use
  2  5 school credit cards to pay for the actual and necessary
  2  6 expenses incurred in the performance of work-related duties.
  2  7    4.  Employees of a school corporation maintaining a high
  2  8 school who have the custody of funds belonging to the
  2  9 corporation or funds derived from extracurricular activities
  2 10 and other sources in the conduct of their duties, shall be
  2 11 required to furnish suitable bond indemnifying the corporation
  2 12 or any activity group connected with the school against loss,
  2 13 and employees who have the custody of property belonging to
  2 14 the corporation or any activity group connected with the
  2 15 school may be required to furnish such bond.  Said bond or
  2 16 bonds may be in such form and penalty as the board may approve
  2 17 and the premiums on same shall be paid from the general fund
  2 18 of the corporation.  
  2 19                           EXPLANATION
  2 20    This bill requires the board of directors of a school
  2 21 district to include in its rules a process for dealing with
  2 22 complaints against district employees.
  2 23    The bill provides that complaints from students, parents,
  2 24 staff, administrators, or other persons against an employee of
  2 25 the district, resulting from an employee's alleged act or
  2 26 omission, shall be in writing and signed by the complaining
  2 27 party.  The employee is to receive a copy of the complaint and
  2 28 be given an opportunity to respond.  The employee's response
  2 29 shall be given appropriate weight.  All parties to the
  2 30 complaint shall be notified in writing of any resolution of
  2 31 the complaint.  A party to the complaint may file with the
  2 32 board a request for a review of the resolution.  All verbal or
  2 33 written information relating to the complaint is confidential.
  2 34 The board shall have exclusive authority to resolve the
  2 35 matter.
