1 1 Section 1. Section 321.445, Code 1997, is amended by
1 2 adding the following new subsection:
1 3 NEW SUBSECTION. 6. A person under the age of seventeen
1 4 shall not ride, and an operator shall not permit a person
1 5 under the age of seventeen to ride, in the open bed of a motor
1 6 truck or in an unenclosed area of a motor vehicle on public
1 7 property or on a highway unless the person is properly seated
1 8 on a seat and wearing a properly adjusted and fastened safety
1 9 belt or safety harness which meets the requirements of
1 10 subsection 1. This subsection does not apply to a motor
1 11 vehicle operated as part of a parade, a motorcycle or
1 12 motorized bicycle, a military motor vehicle, an authorized
1 13 emergency vehicle, an implement of husbandry, or a motor
1 14 vehicle used to transport hunters and hunting dogs during
1 15 hunting activities.
1 16 Sec. 2. EFFECTIVE DATE. This Act takes effect January 1,
1 17 1998.
1 18 EXPLANATION
1 19 This bill prohibits a person under the age of 17 from
1 20 riding in the open bed of a truck, while on public property or
1 21 on a highway without being properly seated and wearing a
1 22 safety belt. The bill does not apply to persons under the age
1 23 of 17 who are participating in a parade, motorcycles or
1 24 motorized bicycles, a military motor vehicle, an authorized
1 25 emergency vehicle, an implement of husbandry, or a vehicle
1 26 used for hunting. A violation is punishable as a simple
1 27 misdemeanor and carries a scheduled fine of $10.
1 28 The bill takes effect January 1, 1998.
