1 1 Section 1. Section 331.439, Code 1997, is amended by
1 2 adding the following new subsection:
1 3 NEW SUBSECTION. 7. A county's management plans submitted
1 4 under this section shall address the service needs of all ages
1 5 of persons for whom expenditures may be made from the county's
1 6 services fund.
1 7 Sec. 2. EFFECTIVE DATE AND APPLICABILITY PROVISION. This
1 8 Act, being deemed of immediate importance, takes effect upon
1 9 enactment. The requirements of this Act shall first apply to
1 10 county mental health, mental retardation, and developmental
1 11 disabilities services plans submitted under section 331.439
1 12 applicable to the fiscal year beginning July 1, 1997. If a
1 13 county's management plan for that fiscal year was submitted
1 14 prior to the effective date of this Act and is not in
1 15 compliance with the provisions of this Act, the county shall
1 16 submit an amendment to the management plan as necessary for
1 17 compliance. The amendment shall be submitted within 60 days
1 18 of the effective date of this Act and is subject to the
1 19 approval provisions of section 331.439.
1 20 EXPLANATION
1 21 This bill relates to requirements for county management
1 22 plans for mental health, mental retardation, and developmental
1 23 disabilities services by requiring a plan to address service
1 24 provisions for all ages of persons for whom the county is
1 25 authorized to pay for services.
1 26 The bill takes effect upon enactment. If a county
1 27 submitted a plan for the fiscal year beginning July 1, 1997,
1 28 which was not in compliance with the requirements of the bill
1 29 prior to the effective date of the bill, the county must
1 30 submit a plan amendment as necessary to comply. The amendment
1 31 must be submitted within 60 days of the bill's effective date
1 32 and is subject to the approval of the director of human
1 33 services.
