1 1 Section 1. Section 901B.1, subsection 3, unnumbered
1 2 paragraph 1, Code 1997, is amended to read as follows:
1 3 An intermediate criminal sanctions program shall consist of
1 4 only levels two, three, and sublevels one, two, and three of
1 5 level four of the corrections continuum and shall be operated
1 6 in accordance with an intermediate criminal sanctions plan
1 7 adopted by the chief judge of the judicial district and the
1 8 director of the judicial district department of correctional
1 9 services. The plan adopted shall be designed to reduce
1 10 probation revocations to prison through the use of
1 11 incremental, community-based sanctions for probation
1 12 violations.
1 13 Sec. 2. Section 901B.1, subsection 4, paragraph a, Code
1 14 1997, is amended to read as follows:
1 15 a. The district department of correctional services shall
1 16 place an individual committed to it under section 907.3 to the
1 17 sanction and level of supervision which is appropriate to the
1 18 individual based upon a current risk assessment evaluation.
1 19 Placements may be to levels two and three of the corrections
1 20 continuum. The district department may place an individual in
1 21 jail for less than thirty days as provided under level four
1 22 only as a penalty for a violation of a condition imposed under
1 23 this section. The district department may also, with the
1 24 approval of the department of corrections, place an individual
1 25 in a level four violator facility established pursuant to
1 26 section 904.207 only as a penalty for a violation of a
1 27 condition imposed under this section.
1 28 EXPLANATION
1 29 This bill adds jail time for less than 30 days to the
1 30 sanctions available within an intermediate criminal sanction
1 31 program and allows a judicial district department of
1 32 correctional services to place an individual in jail for less
1 33 than 30 days as a penalty for violating a condition imposed
1 34 under the intermediate criminal sanctions continuum.
1 35 This bill may create a state mandate.
