1 1 Section 1. Section 455B.310, subsection 1, Code 1997, is
1 2 amended to read as follows:
1 3 1. a. Except as provided in subsection 3, the operator of
1 4 a sanitary landfill shall pay a tonnage fee to the department
1 5 for each ton or equivalent volume of solid waste received and
1 6 disposed of at the sanitary landfill during the preceding
1 7 reporting period. The department shall determine by rule the
1 8 volume which is equivalent to a ton of waste.
1 9 b. The operator of a permitted transfer station shall pay
1 10 a tonnage fee to the department for each ton or equivalent
1 11 volume of solid waste received by the transfer station and
1 12 transported from the transfer station to a final destination
1 13 outside the state during the preceding reporting period. The
1 14 department shall determine by rule the volume which is
1 15 equivalent to a ton of waste. "Transfer station" means a
1 16 fixed or mobile intermediate solid waste disposal facility for
1 17 transferring loads of solid waste, with or without reduction
1 18 of volume, to another transportation unit.
1 19 EXPLANATION
1 20 Currently, the operator of a sanitary landfill must pay a
1 21 tonnage fee for each ton or equivalent volume of solid waste
1 22 received and disposed of at the sanitary landfill. This bill
1 23 provides that the operator of a permitted transfer station
1 24 shall pay a tonnage fee to the department of natural resources
1 25 for each ton or equivalent volume of solid waste which is
1 26 received by the transfer station and transported from the
1 27 transfer station to a final destination outside the state.
