PAG LIN 1 1 Section 1. NEW SECTION. 124.509A STUDY OF MARIJUANA FOR 1 2 MEDICINAL PURPOSES. 1 3 1. INTENT. The general assembly finds that it is 1 4 important to conduct research into the use of marijuana for 1 5 medicinal purposes to determine if or to substantiate that 1 6 marijuana can be safely used under medical supervision and 1 7 that the cannabis plant, in its natural form, has therapeutic 1 8 benefits that are often of critical medical importance to 1 9 persons afflicted with a variety of life-threatening and 1 10 sense-threatening illnesses. 1 11 2. The state university of Iowa hospitals and clinics, in 1 12 conjunction with the board of pharmacy examiners, may perform 1 13 or supervise the performance of research concerning the use of 1 14 marijuana for medicinal purposes. The research may address 1 15 but is not limited to any of the following areas: 1 16 a. Development of laboratory methods for the analysis of 1 17 marijuana confiscated from criminal activities. The analysis 1 18 shall be for the purposes of determining whether the marijuana 1 19 would meet United States food and drug administration 1 20 standards to be used for medical research purposes. 1 21 b. Identification of a tamper-free means of cultivating 1 22 effective and safe marijuana plants to be used for medicinal 1 23 purposes. 1 24 c. Identification of entities appropriate for the 1 25 manufacturing and processing of marijuana for medicinal 1 26 purposes. 1 27 d. Examination of the possible benefits for patients to 1 28 utilize marijuana for medicinal purposes. 1 29 3. Research conducted under this section shall be 1 30 performed under the supervision of the state university of 1 31 Iowa hospitals and clinics, in conjunction with the board of 1 32 pharmacy examiners. The research shall be subject to approval 1 33 of the United States food and drug administration, national 1 34 institute of drug abuse, and other appropriate state and 1 35 federal regulatory authorities. 2 1 4. Notwithstanding contrary provisions of this chapter, it 2 2 is lawful for a person who is approved by the state university 2 3 of Iowa hospitals and clinics, in conjunction with the board 2 4 of pharmacy examiners, to conduct research in accordance with 2 5 this section or to knowingly or intentionally possess 2 6 marijuana for use in connection with the research. 2 7 5. The state university of Iowa hospitals and clinics and 2 8 the board of pharmacy examiners may convene an advisory panel 2 9 consisting of medical experts, law enforcement personnel, 2 10 attorneys, educators, and other interested persons to provide 2 11 guidance to the research conducted under this section. 2 12 6. A report concerning research conducted under this 2 13 section shall be submitted to the governor and the general 2 14 assembly annually in December. 2 15 EXPLANATION 2 16 This bill provides for research concerning the use of 2 17 marijuana for medicinal purposes and makes an appropriation. 2 18 The bill includes a statement as to legislative findings. 2 19 The study may be performed by or supervised by the state 2 20 university of Iowa hospitals and clinics in conjunction with 2 21 the board of pharmacy examiners. The research may address 2 22 various areas specified by the bill. The research is subject 2 23 to approval by designated federal agencies and by other 2 24 federal and state regulatory agencies. 2 25 The bill provides that knowing or intentional possession of 2 26 marijuana in connection with approved research is lawful. An 2 27 advisory panel consisting of various regulatory and 2 28 professional entities may be used to provide guidance to the 2 29 research.
