1 1 Section 1. Section 707.6A, subsection 1, paragraphs a and
1 2 b, Code 1997, are amended to read as follows:
1 3 a. Operating a vessel that is propelled through water by
1 4 an engine while under the influence of an alcoholic beverage
1 5 or drugs in violation of sections 462A.12 and 462A.14 or
1 6 operating a motor vehicle while under the influence of alcohol
1 7 or other drug or a combination of such substances or while
1 8 having an alcohol concentration, as defined in section 321J.1,
1 9 subsection 1, of .10 or more. Upon a plea or verdict of
1 10 guilty of a violation of this paragraph as it relates to the
1 11 operation of motor vehicles, the court shall order the state
1 12 department of transportation to revoke the defendant's motor
1 13 vehicle license or nonresident operating privileges for a
1 14 period of six years. The defendant shall surrender to the
1 15 court any Iowa license or permit and the court shall forward
1 16 it to the department with a copy of the revocation order.
1 17 b. Driving a motor vehicle in a reckless manner with
1 18 willful or wanton disregard for the safety of persons or
1 19 property, in violation of section 321.277, or operating a
1 20 vessel that is propelled through water by an engine in a
1 21 careless, reckless, or negligent manner in violation of
1 22 section 462A.12, subsection 1.
1 23 EXPLANATION
1 24 This bill adds causing a death when operating a vessel that
1 25 is propelled by an engine while intoxicated or while operating
1 26 the vessel in a careless, reckless, or negligent manner to the
1 27 vehicular homicide statute. A person who commits vehicular
1 28 homicide commits a class "C" felony, which is punishable by
1 29 imprisonment of no more than 10 years and a possible fine of
1 30 at least $500 but not more than $10,000. The term "vessel" is
1 31 defined under Iowa Code section 462A.2, subsection 29, as
1 32 every description of watercraft, other than a seaplane, used
1 33 or capable of being used as a means of transportation on water
1 34 or ice and specifically includes ice boats.
