1 1 Section 1. Section 135C.6, Code 1997, is amended by adding
1 2 the following new subsection:
1 3 NEW SUBSECTION. 8A. A residential program which serves
1 4 not more than fifteen individuals and is licensed as an
1 5 intermediate care facility for persons with mental retardation
1 6 under this chapter may surrender the license and continue to
1 7 operate under a federally approved home and community-based
1 8 waiver for persons with mental retardation, if the department
1 9 of human services has approved a plan submitted by the
1 10 residential program which provides for compliance with
1 11 subsection 8, paragraph "a" or "b".
1 12 EXPLANATION
1 13 The bill provides that a licensed intermediate care
1 14 facility for persons with mental retardation may surrender its
1 15 license and continue to operate under a federally approved
1 16 home and community-based waiver if the facility submits a plan
1 17 to the department of human services to bring the facility into
1 18 compliance with the requirements for residential care
1 19 facilities which are currently exempt from licensure.
