PAG LIN 1 1 Section 1. Section 232.52, subsection 2, paragraph e, 1 2 subparagraph (2), Code 1997, is amended to read as follows: 1 3 (2) The child has committed an act which is a crime 1 4 against a person or property and which would be an aggravated 1 5 misdemeanor or a felony if the act were committed by an adult. 1 6 Sec. 2. Section 232.52, subsection 2, paragraph e, Code 1 7 1997, is amended by adding the following new subparagraph: 1 8 NEW SUBPARAGRAPH. (5) The child has failed to comply with 1 9 the conditions required to complete court-ordered community- 1 10 based day programming. 1 11 Sec. 3. Section 232.53, subsection 2, Code 1997, is 1 12 amended to read as follows: 1 13 2.AllExcept as otherwise provided in this section, all 1 14 dispositional orders entered prior to the child attaining the 1 15 age of seventeen years and six months shall automatically 1 16 terminate when the child becomes eighteen years of age. 1 17 Dispositional orders entered subsequent to the child attaining 1 18 the age of seventeen years and six months and prior to the 1 19 child's eighteenth birthday shall automatically terminate one 1 20 year after the date of disposition. In the case of a child 1 21 who has been adjudicated delinquent for an offense which would 1 22 constitute sexual abuse under chapter 709, and who has been 1 23 ordered to participate in a sexual abusers treatment program 1 24 and has commenced but not completed the program prior to 1 25 attaining eighteen years of age, the dispositional order shall 1 26 automatically terminate when the child attains nineteen years 1 27 of age. In the case of an adult within the jurisdiction of 1 28 the court under the provisions of section 232.8, subsection 1, 1 29 the dispositional order shall automatically terminate one year 1 30 after the last date upon which jurisdiction could attach. 1 31 EXPLANATION 1 32 This bill expands the criteria which may be used as the 1 33 basis for admission of delinquent juveniles to the state 1 34 training school to include both the commission of aggravated 1 35 misdemeanors or felonies which are crimes against property and 2 1 the failure to comply with community-based day programming 2 2 requirements. Currently, only commission of aggravated 2 3 misdemeanors or felony offenses which would be crimes against 2 4 a person and other enumerated circumstances may be used as a 2 5 criterion for admission to the state training school. 2 6 The bill also provides for the extension of dispositional 2 7 orders which pertain to juveniles who have been adjudicated 2 8 delinquent for offenses which would constitute sexual abuse 2 9 under Code chapter 709 if the juvenile has been ordered to 2 10 participate in sexual abusers treatment and has not completed 2 11 the treatment by the time that the juvenile has reached the 2 12 age of 18. Under those circumstances, the dispositional order 2 13 would not terminate until the juvenile reaches the age of 19. 2 14 LSB 1838HH 77 2 15 lh/jw/5
