Section 2.32, subsection 6, unnumbered 1 2 paragraph 1, Code 1997, is amended to read as follows: 1 3 The confirmation of every appointment submitted to the 1 4 senate requires the approval oftwo-thirdsa majority ofthe1 5 all membersofelected to the senate. 1 6 Sec. 2. Section 2.32, subsection 8, Code 1997, is amended 1 7 by striking the subsection. 1 8 Sec. 3. Section 333A.2, subsection 1, paragraph b, Code 1 9 1997, is amended to read as follows: 1 10 b. Five elected county officials who are regularly 1 11 involved in budget preparation. One county official shall be 1 12 from a county with a population of less than eleven thousand 1 13 five hundred, one from a county with a population of more than 1 14 eleven thousand five hundred but not more than sixteen 1 15 thousand, one from a county with a population of more than 1 16 sixteen thousand but not more than twenty-two thousand five 1 17 hundred, one from a county with a population of more than 1 18 twenty-two thousand five hundred but not more than eighty 1 19 thousand and one from a county with a population of more than 1 20 eighty thousand. The governor shall select and appoint the 1 21 county officials, subject tothe approval of two-thirds of the1 22members ofconfirmation by the senate. 1 23 Sec. 4. Section 333A.2, subsection 1, paragraph c, Code 1 24 1997, is amended to read as follows: 1 25 c. A certified public accountant experienced in 1 26 governmental accounting selected and appointed by the governor 1 27with the approval of two-thirds of the members of, subject to 1 28 confirmation by the senate. 1 29 Sec. 5. Section 80.3, Code 1997, is repealed. 1 30 EXPLANATION 1 31 This bill provides for modifications to the senate 1 32 confirmation process for gubernatorial appointments. 1 33 Code section 2.32, subsection 6, states that approval of 1 34 appointments submitted to the senate requires a two-thirds 1 35 favorable vote. This bill reduces the required number of 2 1 votes for approval to a majority vote of all members elected 2 2 to the senate. Code section 2.32, subsection 8, requires that 2 3 previously approved gubernatorial appointees are subject to 2 4 reconfirmation by the senate every four years, with the same 2 5 confirmation procedures applicable as with an initial 2 6 appointment. This bill repeals this subsection. 2 7 The bill also repeals or modifies the inconsistent 2 8 provisions of Code section 80.3, relating to appointments to 2 9 fill vacancies in the position of commissioner of public 2 10 safety, and Code section 333A.2, relating to county finance 2 11 committee membership, to promote consistency with Code section 2 12 2.32 modifications. 2 13 LSB 1575HH 77 2 14 rn/jj/8
