1 1 Section 1. NEW SECTION. 514C.13 POSTMASTECTOMY PROCEDURE
1 2 BENEFITS AND CARE.
1 3 1. Notwithstanding section 514C.6, a person who provides
1 4 an individual or group policy of accident or health insurance
1 5 or individual or group hospital or health care service
1 6 contract issued pursuant to chapter 509, 509A, 514, or 514A or
1 7 an individual or group health maintenance organization
1 8 contract issued and regulated under chapter 514B, which is
1 9 delivered, amended, or renewed on or after July 1, 1997, and
1 10 which provides mastectomy procedure benefits, shall not
1 11 terminate inpatient benefits or require discharge of a patient
1 12 from a hospital earlier than a minimum of forty-eight hours
1 13 following a mastectomy procedure except as otherwise provided
1 14 in this section.
1 15 2. A patient may be discharged from a hospital earlier
1 16 than forty-eight hours following a mastectomy procedure if the
1 17 attending physician determines, in accordance with the
1 18 protocols and guidelines developed by the American college of
1 19 surgeons, that the patient meets the appropriate guidelines
1 20 for that length of stay based upon evaluation of the patient
1 21 and the coverage for and availability of a postdischarge
1 22 physician office visit or in-home visit by a registered nurse
1 23 licensed to practice pursuant to chapter 152 to verify the
1 24 condition of the patient in the initial forty-eight hours
1 25 after the discharge.
1 26 EXPLANATION
1 27 This bill prohibits an individual or group policy of
1 28 accident or health insurance, an individual or group hospital
1 29 or health care service contract, or an individual or group
1 30 health maintenance organization contract, which is delivered,
1 31 amended, or renewed on or after July 1, 1997, and which
1 32 provides mastectomy procedure benefits, from terminating in-
1 33 patient benefits or requiring discharge of a patient from the
1 34 hospital earlier than a minimum of 48 hours following a
1 35 mastectomy procedure unless the attending physician
2 1 determines, in accordance with protocols and guidelines
2 2 developed by the American college of surgeons, that the
2 3 patient meets the appropriate guidelines for that length of
2 4 stay based upon an evaluation of the patient and coverage for
2 5 and availability of a postdischarge physician office visit or
2 6 a home visit by a registered nurse within 48 hours following
2 7 the discharge.
