1 2 1997, is amended by striking the paragraph.
1 3 Sec. 2. Section 453A.56, Code 1997, is amended by striking
1 4 the section and inserting in lieu thereof the following:
1 5 453A.56 LOCAL LAWS AND REGULATIONS.
1 6 A city or county may adopt laws or regulations specifically
1 7 targeted to reduce or eliminate access to, sale to, or use of
1 8 cigarettes or tobacco products by persons under eighteen years
1 9 of age which shall supersede any inconsistent or conflicting
1 10 provision of this chapter.
1 11 EXPLANATION
1 12 This bill eliminates the provision in the smoking
1 13 prohibitions chapter (Code chapter 142B) which provides that
1 14 local laws and rules are superseded if they are inconsistent
1 15 or conflict with the provisions of the Code chapter.
1 16 The bill also replaces the provision in the cigarette and
1 17 tobacco products chapter (Code chapter 453A) which requires
1 18 uniform application of the Code chapter with language which
1 19 allows cities and counties to adopt laws or regulations which
1 20 are specifically targeted to reduce or eliminate access to,
1 21 sale to, or use of cigarettes or tobacco products by persons
1 22 under 18 years of age.
