1 1 Section 1. Section 260C.14, Code 1997, is amended by adding
1 2 the following new subsection:
1 3 NEW SUBSECTION. 22. Annually submit to the department of
1 4 education by August 15, on forms designed by the department of
1 5 education in consultation with the community colleges,
1 6 information relating to the fiscal year ending the previous
1 7 June 30, which shall include, but is not limited to, the
1 8 following:
1 9 a. The number of full-time and part-time students enrolled
1 10 in each program offered by the community college, listed by
1 11 program.
1 12 b. The number of and any appropriate demographic
1 13 information, including salaries, of full-time and part-time
1 14 staff, including the faculty, administration, and support
1 15 personnel employed at each community college.
1 16 c. The full-time equivalent total of persons employed as
1 17 identified in paragraph "b".
1 18 d. Tuition charges, fees, and other costs payable to the
1 19 community college by a student.
1 20 e. The types of degrees granted by the community college
1 21 and the numbers of students receiving these degrees.
1 22 f. The amounts of revenues and expenditures from state
1 23 financial aid, federal funds, tax levies, projects authorized
1 24 under chapters 260E and 260F, tuition, bonds, other local
1 25 sources, foundation sources, and donations and gifts that have
1 26 been accepted by the governing board of a community college.
1 27 g. An inventory of buildings and facilities owned and
1 28 leased by the community college, and any related operation and
1 29 maintenance costs.
1 30 h. Infrastructure plans, which shall include, but are not
1 31 limited to, the amounts expended on renovation and
1 32 construction, and any future plans and projected costs for
1 33 expansion.
1 34 The department of education may withhold from a community
1 35 college any state financial assistance appropriated to the
2 1 department for allocation to the community college if the
2 2 community college fails to substantially meet the requirements
2 3 of this subsection.
2 4 Sec. 2. LEGISLATIVE STUDY.
2 5 1. There is created a legislative task force to study the
2 6 need for the community colleges to operate effectively and
2 7 efficiently as a state system, while recognizing the strong
2 8 local character of community colleges. The study shall
2 9 include, but is not limited to, a review of the governance
2 10 system of the community colleges; ongoing collaboration among
2 11 the community colleges; changes necessary to enhance the
2 12 accountability of community colleges; the relationships
2 13 between community colleges and local school districts; the
2 14 relationships between community colleges, the department of
2 15 education, and the state board of education; and the
2 16 relationship between community colleges and other accredited
2 17 postsecondary institutions in Iowa.
2 18 2. Membership on the task force shall consist of the
2 19 following:
2 20 a. Three voting members from the senate to be appointed by
2 21 the majority leader of the senate in consultation with the
2 22 president and the minority leader.
2 23 b. Three voting members from the house of representatives
2 24 to be appointed by the speaker of the house in consultation
2 25 with the minority leader.
2 26 c. Three voting members to be chosen by legislative
2 27 members on the task force.
2 28 d. The director of the department of education, or the
2 29 director's designee, who shall serve as a nonvoting, ex
2 30 officio member.
2 31 The chairperson and vice chairperson of the task force
2 32 shall be chosen from among the voting nonlegislative members
2 33 by a majority vote of the legislative members. Nonlegislative
2 34 members of the task force shall be reimbursed for actual and
2 35 necessary expenses incurred in performance of the duties.
3 1 Expense moneys paid to nonlegislative members shall be paid
3 2 from funds appropriated to the task force. Legislative
3 3 members of the task force shall receive payment pursuant to
3 4 sections 2.10 and 2.12.
3 5 3. From the moneys appropriated to the general assembly in
3 6 section 2.12, not more than $90,000 for the fiscal year
3 7 beginning July 1, 1997, and ending June 30, 1998, shall be
3 8 allocated to the task force created in subsection 1 for
3 9 purposes of the payment of services of a consultant to assist
3 10 the task force, or for the task force to contract for an
3 11 independent study of the issues identified in subsection 1.
3 12 4. The task force shall submit its findings and
3 13 recommendations to the general assembly by December 1, 1997.
3 14 Staff assistance to the task force shall be provided by the
3 15 legislative service bureau and the legislative fiscal bureau
3 16 and the staffs shall cooperate with and coordinate the work of
3 17 the task force with the consultant if a consultant is
3 18 employed.
3 19 EXPLANATION
3 20 This bill requires the boards of directors of the community
3 21 colleges to provide certain specified information relating to
3 22 programs, buildings, students, and community college staff
3 23 members annually to the department of education and creates a
3 24 legislative task force to study the need for the community
3 25 colleges to operate effectively and efficiently as a state
3 26 system, while recognizing the strong local character of
3 27 community colleges.
3 28 The bill grants authority to the department of education to
3 29 withhold from a community college any state financial
3 30 assistance appropriated to the department for allocation to
3 31 the community college if the community college fails to
3 32 substantially meet the information requirements.
3 33 The bill creates a legislative task force to study the need
3 34 for the community colleges to operate effectively and
3 35 efficiently as a state system, while recognizing the strong
4 1 local character of community colleges. Under the bill, the
4 2 legislative task force study shall include, but is not limited
4 3 to, a review of the governance system of the community
4 4 colleges; changes to enhance the accountability of community
4 5 colleges; ongoing collaboration among the community colleges;
4 6 the relationship between community colleges and local school
4 7 districts; the relationship between community colleges, the
4 8 department of education, and the state board of education; and
4 9 the relationship between community colleges and other
4 10 accredited postsecondary institutions in Iowa.
4 11 Membership on the task force shall consist of three voting
4 12 members from the senate to be appointed by the president of
4 13 the senate in consultation with the minority leader, three
4 14 voting members from the house of representatives to be
4 15 appointed by the speaker of the house in consultation with the
4 16 minority leader, and three voting members to be chosen by
4 17 legislative members on the task force. The director of the
4 18 department of education, or the director's designee, shall
4 19 serve as a nonvoting, ex officio member.
4 20 From the moneys appropriated for legislative expenses, the
4 21 bill allocates not more than $90,000 for the 1997-1998 fiscal
4 22 year to the task force for the payment of services of a
4 23 professional facilitator to assist the task force, or for the
4 24 task force to contract for an independent study of the issues
4 25 identified in the bill.
4 26 The task force shall submit its findings and
4 27 recommendations to the general assembly meeting in 1998.
