PAG LIN 1 1 Section 1. Section 724.11, Code 1997, is amended to read 1 2 as follows: 1 3 724.11 ISSUANCE OF PERMIT TO CARRY WEAPONS. 1 4 Applications for permits to carry weapons shall be made to 1 5 the sheriff of the county in which the applicant resides. 1 6 Applications from persons who are nonresidents of the state, 1 7 or whose need to go armed arises out of employment by the 1 8 state, shall be made to the commissioner of public safety. A 1 9 person who retired as a peace officer employed by the 1 10 department of public safety and who was issued a professional 1 11 permit to carry weapons while employed as a peace officer may 1 12 also apply to the commissioner of public safety. Ineither1 13 each case, the issuance of the permit shall be by and at the 1 14 discretion of the sheriff or commissioner, who shall, before 1 15 issuing the permit, determine that the requirements of 1 16 sections 724.6 to 724.10 have been satisfied. However, the 1 17 training program requirements in section 724.9 may be waived 1 18 for renewal permits or for a person who retired as a peace 1 19 officer employed by the department of public safety. The 1 20 issuing officer shall collect a fee of ten dollars, except 1 21 from a duly appointed peace officer or correctional officer, 1 22 for each permit issued. Renewal permits or duplicate permits 1 23 shall be issued for a fee of five dollars. The issuing 1 24 officer shall notify the commissioner of public safety of the 1 25 issuance of any permit at least monthly and forward to the 1 26directorcommissioner an amount equal to two dollars for each 1 27 permit issued and one dollar for each renewal or duplicate 1 28 permit issued. All such fees received by the commissioner 1 29 shall be paid to the treasurer of state and deposited in the 1 30 operating account of the department of public safety to offset 1 31 the cost of administering this chapter. Any unspent balance 1 32 as of June 30 of each year shall revert to the general fund as 1 33 provided by section 8.33. 1 34 EXPLANATION 1 35 This bill authorizes persons who retired as peace officers 2 1 employed by the department of public safety to apply to the 2 2 commissioner of public safety for a nonprofessional permit to 2 3 carry weapons, rather than the county sheriff. The bill also 2 4 waives training program requirements for persons who retired 2 5 as a peace officer employed by the department of public 2 6 safety. 2 7 LSB 1629HH 77 2 8 mk/sc/14
