  1  1    Section 1.  Section 455B.171, Code 1997, is amended by
  1  2 adding the following new subsections:
  1  3    NEW SUBSECTION.  2A.  "Animal feeding operation structure"
  1  4 means the same as defined in section 455B.161.
  1  5    NEW SUBSECTION.  29A.  "Spray irrigation equipment" means
  1  6 mechanical equipment commonly used for the artificial
  1  7 application of water to growing crops if the equipment is
  1  8 connected by hoses or pipes to an animal feeding operation
  1  9 structure containing manure and the equipment is used for the
  1 10 aerial application of manure to growing crops.
  1 11    Sec.  2.  Section 455B.201, subsection 4, Code 1997, is
  1 12 amended to read as follows:
  1 13    4.  A person shall not apply manure by spray irrigation
  1 14 equipment to land, if surface or subsurface water from the
  1 15 land drains into an agricultural drainage well or known
  1 16 sinkhole.  A person shall not otherwise apply manure to land
  1 17 by spray irrigation equipment, except as provided by rules
  1 18 which shall be adopted by the department pursuant to chapter
  1 19 17A.  
  1 20                           EXPLANATION
  1 21    Code section 455B.201 provides that a person may apply
  1 22 manure to land by spray irrigation equipment only as provided
  1 23 by rules adopted by the department of natural resources.  This
  1 24 bill prohibits a person from applying manure by spray
  1 25 irrigation equipment to land, if surface or subsurface water
  1 26 from the land drains into an agricultural drainage well or
  1 27 known sinkhole.
