1 1 Section 1. Section 75.1, Code 1997, is amended by adding
1 2 the following new unnumbered paragraph:
1 3 NEW UNNUMBERED PARAGRAPH. A proposition to authorize an
1 4 issuance of bonds by a county, township, school corporation,
1 5 city, or by any local board or commission shall be submitted
1 6 to the electors residing in the political subdivision seeking
1 7 to issue the bonds and to electors who are residents of the
1 8 state but do not reside in the political subdivision seeking
1 9 to issue the bonds but who own real estate located within the
1 10 boundaries of the political subdivision. Electors who are
1 11 residents of the state but do not reside in the political
1 12 subdivision seeking to issue the bonds but who own real estate
1 13 located within the boundaries of the political subdivision
1 14 shall cast a ballot as if it were a challenged ballot
1 15 following the procedures of section 49.81 and shall submit
1 16 along with the ballot proof of ownership of real estate
1 17 located within the political subdivision.
1 18 EXPLANATION
1 19 This bill provides that electors who reside in Iowa but not
1 20 within a political subdivision proposing a bond issuance may
1 21 vote in the election authorizing the issuance of the bonds if
1 22 the electors own real estate in the political subdivision.
1 23 The landowner would vote using the challenged ballot procedure
1 24 and would be required to provide proof of ownership of real
1 25 estate located in the political subdivision.
