PAG LIN 1 1 Section 1. Section 8.59, Code 1997, is amended to read as 1 2 follows: 1 3 8.59 APPROPRIATIONS FREEZE. 1 4 Notwithstanding contrary provisions of the Code, the 1 5 amounts appropriated under the applicable sections of the Code 1 6 for fiscal years commencing on or after July 1, 1993, are 1 7 limited to those amounts expended under those sections for the 1 8 fiscal year commencing July 1, 1992. If an applicable section 1 9 appropriates moneys to be distributed to different recipients 1 10 and the operation of this section reduces the total amount to 1 11 be distributed under the applicable section, the moneys shall 1 12 be prorated among the recipients. As used in this section, 1 13 "applicable sections" means the following sections: 53.50, 1 14 229.35, 230.8, 230.11, 405A.8, 411.20,425.1, 425.39, 426A.1,1 15 663.44, and 822.5. 1 16 Sec. 2. Section 425.39, subsection 1, Code 1997, is 1 17 amended to read as follows: 1 181.The extraordinary property tax credit and reimbursement 1 19 fund is created. There is appropriated annually from the 1 20 general fund of the state to the department of revenue and 1 21 finance to be credited to the extraordinary property tax 1 22 credit and reimbursement fund, from funds not otherwise 1 23 appropriated, an amount sufficient to implement this division 1 24 for claimants described in section 425.17, subsection 2, 1 25 paragraph "a". 1 26 Sec. 3. Section 425.39, subsection 2, Code 1997, is 1 27 amended by striking the subsection. 1 28 Sec. 4. This Act applies to reimbursements made for 1 29 property tax credits and to reimbursements for rent 1 30 constituting property taxes payable on or after July 1, 1997. 1 31 EXPLANATION 1 32 State reimbursement to local governments for the homestead 1 33 credit, the low-income elderly and disabled additional 1 34 homestead credit and rent reimbursement, and the military 1 35 service exemption and credit were frozen beginning with the 2 1 1993-1994 fiscal year at the 1992-1993 fiscal year levels. 2 2 The bill eliminates the freeze and provides for standing 2 3 appropriations to fund these credits and reimbursements at the 2 4 level prior to the freeze. 2 5 The bill applies to reimbursements made on or after July 1, 2 6 1997. 2 7 LSB 1247HH 77 2 8 mg/sc/14.1
