1 1 Section 1. Section 709.4, Code 1997, is amended by adding
1 2 the following new subsection:
1 3 NEW SUBSECTION. 3. The act is performed while the other
1 4 participant is under the influence of a substance listed under
1 5 section 124.204 as a schedule I controlled substance and both
1 6 of the following are true:
1 7 a. The controlled substance prevents the other participant
1 8 from resisting the act.
1 9 b. The person performing the act knows or reasonably
1 10 should have known that the other participant was under the
1 11 influence of the controlled substance.
1 12 EXPLANATION
1 13 This bill prohibits, as sexual abuse in the third degree, a
1 14 sex act in which the other participant is under the influence
1 15 of a schedule I controlled substance which prevents the other
1 16 participant from resisting the sex act and the person
1 17 committing the sex act knows or reasonably should have known
1 18 that the other participant was under the influence of the
1 19 controlled substance. Sexual abuse in the third degree is a
1 20 class "C" felony, punishable by confinement in prison for no
1 21 more than 10 years and a fine of at least $500, but no more
1 22 than $10,000.
