1 1 Section 1. NEW SECTION. 99B.9B USE OF YOUNG OR SMALL
1 2 ANIMALS AS AWARDS OR PRIZES PROHIBITED – PENALTY.
1 3 1. As used in this section:
1 4 a. "Small animal" includes, but is not limited to, a
1 5 goldfish, turtle, or rodent.
1 6 b. "Young animal" includes, but is not limited to, a
1 7 rabbit bunny, baby chicken, kitten, or puppy.
1 8 2. A person licensed to conduct games of skill or games of
1 9 chance pursuant to this chapter shall not offer to give or
1 10 give a young animal or small animal as a prize, gift, or door
1 11 prize as a part of the conduct of a game of skill or game of
1 12 chance.
1 13 3. The department shall adopt rules, subject to chapter
1 14 17A, prohibiting a licensee under this chapter from awarding
1 15 or giving a small animal or young animal as a gift, prize, or
1 16 door prize.
1 17 4. A person who violates this section or a rule adopted
1 18 pursuant to this section is guilty of a simple misdemeanor.
1 19 EXPLANATION
1 20 This bill directs the department of inspections and appeals
1 21 to adopt rules prohibiting licensees of raffle games, bingo,
1 22 and other games of skill or chance from giving small or young
1 23 animals as prizes, gifts, or door prizes. The animals include
1 24 goldfish, rabbit bunnies, rodents such as mice and gerbils,
1 25 turtles, baby chickens, puppies, and kittens.
1 26 A violator is guilty of a simple misdemeanor.
