  1  1    Section 1.  Section 20.22, subsection 9, paragraph b, Code
  1  2 1997, is amended to read as follows:
  1  3    b.  Comparison of wages, hours and conditions of employment
  1  4 of the involved public employees with those of other public
  1  5 and private employees doing comparable work, giving
  1  6 consideration to factors peculiar to the area and the
  1  7 classifications involved.
  1  8    Sec. 2.  Section 20.22, subsection 9, paragraph c, Code
  1  9 1997, is amended to read as follows:
  1 10    c.  The interests and welfare of the public, the ability of
  1 11 the public employer to finance pay for any economic
  1 12 adjustments and the effect of such payment of any economic
  1 13 adjustments on the normal standard of services financial
  1 14 position of the public employer including the public
  1 15 employer's ability to provide other necessary services.
  1 16    Sec. 3.  Section 20.22, subsection 9, paragraph d, Code
  1 17 1997, is amended by striking the paragraph.
  1 18    Sec. 4.  EFFECTIVE AND APPLICABILITY DATES.  This Act,
  1 19 being deemed of immediate importance, takes effect upon
  1 20 enactment and applies to collective bargaining negotiations
  1 21 that have commenced, but have not been finalized, as of the
  1 22 effective date of this Act, and to all subsequent collective
  1 23 bargaining negotiations commenced after that date.  
  1 24                           EXPLANATION
  1 25    This bill requires arbitrators in public employee
  1 26 collective bargaining disputes to compare, as a factor in
  1 27 resolving an impasse, the wages, hours, and conditions of
  1 28 employment of the involved public employees with those of
  1 29 private employees doing comparable work.
  1 30    The bill also provides that an arbitrator in binding
  1 31 arbitration shall consider the effect of any award on the
  1 32 public employer's overall financial position and its ability
  1 33 to provide other necessary services.  The bill also eliminates
  1 34 as a required factor for consideration by an arbitrator the
  1 35 power of the employer to levy taxes and appropriate funds.
  2  1    This bill takes effect upon enactment and applies to
  2  2 negotiations ongoing, but not yet finalized, as of that date,
  2  3 and to all subsequent negotiations commenced after the date.
