1 1 Section 1. Section 321.34, Code 1997, is amended by adding
1 2 the following new subsection:
1 3 NEW SUBSECTION. 8A. EX-PRISONER OF WAR SPECIAL PLATES.
1 4 The owner of a motor vehicle subject to registration under
1 5 section 321.109, subsection 1, light delivery truck, panel
1 6 delivery truck, or pickup who was a prisoner of war during the
1 7 Second World War at any time between December 7, 1941, and
1 8 December 31, 1946, the Korean Conflict at any time between
1 9 June 25, 1950, and January 31, 1955, or the Vietnam Conflict
1 10 at any time between August 5, 1964, and June 30, 1973, all
1 11 dates inclusive, may, upon written application to the
1 12 department, order special registration plates with an ex-
1 13 prisoner of war processed emblem with the emblem designed by
1 14 the department in cooperation with the adjutant general which
1 15 emblem signifies that the owner was a prisoner of war as
1 16 described in this subsection. The application is subject to
1 17 approval by the department, in consultation with the adjutant
1 18 general. The special plates are subject to an annual fee of
1 19 fifteen dollars. The department shall validate the special
1 20 plates in the same manner as regular registration plates are
1 21 validated under this section.
1 22 The surviving spouse of a person who was issued special
1 23 plates under this subsection may continue to use the special
1 24 plates subject to registration of the special plates in the
1 25 surviving spouse's name and upon payment of the annual
1 26 registration fee. If the surviving spouse remarries, the
1 27 surviving spouse shall return the special plates to the
1 28 department and the department shall issue regular registration
1 29 plates to the surviving spouse.
1 30 Sec. 2. Section 321.34, subsection 15, Code 1997, is
1 31 amended by striking the subsection.
1 32 Sec. 3. EFFECTIVE AND APPLICABILITY DATE. This Act, being
1 33 deemed of immediate importance, takes effect upon enactment
1 34 and is retroactively applicable to January 1, 1997. The
1 35 county treasurer shall refund to an owner any registration
2 1 fees in excess of fifteen dollars paid by the owner for ex-
2 2 prisoner of war special plates.
2 3 EXPLANATION
2 4 This bill provides that the fee for ex-prisoner of war
2 5 special motor vehicle registration plates is only $15 and does
2 6 not include the regular annual registration fee and provides
2 7 that the department of transportation is to validate the
2 8 plates in the same manner as regular plates.
2 9 The bill takes effect upon enactment and is retroactively
2 10 effective to January 1, 1997. The bill requires county
2 11 treasurers to refund the registration fees paid for the plates
2 12 which is above $15.
