1 2 BY FALLON, VANDE HOEF, CONNORS, BODDICKER, MYERS,
1 3 WELTER, WITT, CARROLL, SCHRADER, GRUNDBERG,
1 4 BURNETT, and MASCHER
1 5 A Concurrent Resolution establishing a special commis-
1 6 sion to study and make recommendations concerning
1 7 urban planning, growth management of cities, and
1 8 protection of farmland.
1 9 WHEREAS, it is the intent of the General Assembly
1 10 to provide for the orderly use and development of land
1 11 in the state, to preserve private property rights, to
1 12 preserve the use of prime agricultural land for
1 13 agricultural production, to preserve natural,
1 14 cultural, and historical areas, and to provide for the
1 15 coordination of comprehensive plans for land use; and
1 16 WHEREAS, it is the intent of the General Assembly
1 17 to control urban sprawl, and thereby provide for the
1 18 protection and preservation of the private and public
1 19 interest in the land, water, and related resources of
1 20 this state for the public health, safety, and general
1 21 welfare, and for the benefit of present and future
1 22 generations; NOW THEREFORE,
1 23 BE IT RESOLVED BY THE HOUSE OF REPRESENTATIVES, THE
1 24 SENATE CONCURRING, That a special commission shall be
1 25 established to study urban planning, growth
1 26 management, and farmland protection; and
1 27 BE IT FURTHER RESOLVED, That the special commission
1 28 shall consist of 21 voting members with diverse
1 29 expertise in planning, development, design, zoning,
1 30 annexation, agriculture, historic preservation, and
2 1 conservation, including all of the following:
2 2 1. Four members of the general assembly with not
2 3 more than one member from each chamber being from the
2 4 same political party. The two senators shall be
2 5 designated by the majority leader of the Senate after
2 6 consultation with the minority leader of the Senate.
2 7 The two representatives shall be designated by the
2 8 Speaker of the House of Representatives after
2 9 consultation with the majority and minority leaders of
2 10 the House of Representatives. Of the members from
2 11 each chamber, one member shall represent a district
2 12 which is primarily urban, while the other member shall
2 13 represent a district which is primarily rural.
2 14 2. One member appointed by the Governor.
2 15 3. The executive director of the Iowa Farm Bureau
2 16 Federation or a designee of the executive director.
2 17 4. The executive director of the Iowa Farmers'
2 18 Union or a designee of the executive director.
2 19 5. The executive director of the Iowa League of
2 20 Cities or a designee of the executive director.
2 21 6. The executive director of the Iowa State
2 22 Association of Counties or a designee of the executive
2 23 director.
2 24 7. The chairperson of the Department of Community
2 25 and Regional Planning in the College of Design at Iowa
2 26 State University of Science and Technology.
2 27 8. The president of the Iowa Chapter of the
2 28 American Planning Association or a designee of the
2 29 president.
2 30 9. The executive director of the Associated
3 1 Builders and Contractors of Iowa, Inc. or a designee
3 2 of the executive director.
3 3 10. The executive director of the Iowa Association
3 4 of Soil and Water Conservation District Commissioners
3 5 or a designee of the executive director.
3 6 11. The executive director of the Iowa Historic
3 7 Preservation Alliance or a designee of the executive
3 8 director.
3 9 12. The president of the Iowa Chapter of the
3 10 American Society of Landscape Architects or a designee
3 11 of the president.
3 12 13. The executive director of the Iowa Chapter of
3 13 the American Institute of Architects or a designee of
3 14 the executive director.
3 15 14. The executive director of the Iowa Natural
3 16 Heritage Foundation or a designee of the executive
3 17 director.
3 18 15. The executive director of the Iowa Public
3 19 Transit Association or a designee of the executive
3 20 director.
3 21 16. The executive director of the Iowa Sportsmen's
3 22 Federation or a designee of the executive director.
3 23 17. The president of the Iowa Audubon Council or a
3 24 designee of the president.
3 25 18. One member appointed jointly by the farm
3 26 commodity organizations of the state; and
3 27 BE IT FURTHER RESOLVED, That the co-chairpersons of
3 28 the special commission shall be the General Assembly
3 29 members of the majority party from each chamber; and
3 30 BE IT FURTHER RESOLVED, That the special commission
4 1 shall do all of the following:
4 2 1. Review the county land-use inventories compiled
4 3 pursuant to chapter 352 and survey the status of Iowa
4 4 farmland and natural areas since the compilation of
4 5 the county land-use inventories to determine the
4 6 extent to which these areas have been converted to
4 7 residential, commercial, or industrial use. The
4 8 survey shall also report on the agricultural quality
4 9 of the farmland converted to residential, commercial,
4 10 or industrial use.
4 11 2. Survey the problems facing the state's cities
4 12 including, but not limited to, problems involving
4 13 crime, poverty, infrastructure, housing, and taxation.
4 14 3. Evaluate the effectiveness of current state,
4 15 regional, and local planning and zoning laws and
4 16 assess their impact on the farmland, natural areas,
4 17 and cities of the state.
4 18 4. Review model legislation and studies on
4 19 farmland protection and urban planning and collect
4 20 information on states that have undertaken reform
4 21 efforts and have effective programs.
4 22 5. During 1997, hold public hearings throughout
4 23 the state to share the initial findings of the special
4 24 commission and solicit public comment and input on
4 25 steps that might be taken to address the charge of the
4 26 special commission.
4 27 6. Propose innovative and cooperative planning and
4 28 land-use approaches that will protect farmland,
4 29 accommodate and guide growth and development, ensure
4 30 the planning and construction of adequate supporting
5 1 services and infrastructure including utilities, storm
5 2 water management systems, and transportation, provide
5 3 opportunities for or eliminate barriers to affordable
5 4 housing, protect the environment, minimize exposure to
5 5 natural hazards, and generally address the concerns
5 6 outlined in this resolution.
5 7 7. At the discretion of the special commission,
5 8 hold a second series of public hearings in the fall of
5 9 1998; and
5 10 BE IT FURTHER RESOLVED, That the special commission
5 11 shall convene each month; and
5 12 BE IT FURTHER RESOLVED, That the special commission
5 13 shall submit an interim report to the General Assembly
5 14 no later than January 1, 1998, which shall include,
5 15 but not be limited to, a status report of the
5 16 commission's actions and an explanation of future
5 17 plans; and
5 18 BE IT FURTHER RESOLVED, That the special commission
5 19 shall submit a final report to the General Assembly no
5 20 later than December 1, 1998, which shall include, but
5 21 not be limited to, findings, analysis, and
5 22 recommendations by the special commission; and
5 23 BE IT FURTHER RESOLVED, That the Legislative
5 24 Council pursuant to its authority in section 2.43 may
5 25 allocate funding from moneys available to it in
5 26 section 2.12, to the special commission created in
5 27 this resolution for studies, consultants, surveys, and
5 28 reimbursement of any public or private department or
5 29 agency that provides staffing services for the
5 30 commission.
