  1  1    Amend Senate File 2345, as amended, passed, and
  1  2 reprinted by the Senate, as follows:
  1  3    #1.  Page 9, by inserting after line 8 the
  1  4 following:
  1  5    "Sec. ___.  Section 232.147, subsection 3, Code
  1  6 Supplement 1997, is amended by adding the following
  1  7 new paragraph:
  1  8    NEW PARAGRAPH.  h.  If authorized by a subject of a
  1  9 child abuse report as identified in section 235A.15,
  1 10 subsection 2, paragraph "a", or by the parent,
  1 11 guardian, or custodian of a child receiving services
  1 12 or involved in a proceeding under this chapter, to a
  1 13 statewide elected official, as defined in section
  1 14 68B.2, a member of the general assembly, or a designee
  1 15 of the statewide elected official or member of the
  1 16 general assembly.  The purpose of the disclosure shall
  1 17 be for the elected official, member of the general
  1 18 assembly, or designee to monitor compliance of state
  1 19 agencies, officials, and employees with requirements
  1 20 under law and the adequacy of the requirements.  The
  1 21 authorization under this paragraph shall encompass
  1 22 information in the record which is subject to section
  1 23 217.30 or 228.3 and relates to the person providing
  1 24 the authorization or to a child of the person.  The
  1 25 penalties applicable to violations of section 217.30
  1 26 or 228.3 are applicable to unauthorized disclosures of
  1 27 information which are subject to section 217.30 or
  1 28 228.3.
  1 29    Sec. ___.  Section 232.147, subsection 5, Code
  1 30 Supplement 1997, is amended by adding the following
  1 31 new unnumbered paragraph:
  1 32    NEW UNNUMBERED PARAGRAPH.  An individual authorized
  1 33 under subsection 3, paragraph "h", to inspect official
  1 34 juvenile court records, may inspect social records and
  1 35 the contents of the records and the official juvenile
  1 36 court records of cases alleging delinquency shall be
  1 37 disclosed to such individual for the purposes
  1 38 described in subsection 3, paragraph "h".  The
  1 39 authorization under this paragraph shall encompass
  1 40 information in the record which is subject to section
  1 41 217.30 or 228.3 and relates to the person providing
  1 42 the authorization or to a child of the person.  The
  1 43 penalties applicable to violations of section 217.30
  1 44 or 228.3 are applicable to unauthorized disclosures of
  1 45 information which are subject to section 217.30 or
  1 46 228.3."
  1 47    #2.  Page 9, by inserting after line 23 the
  1 48 following:
  1 49    "Sec. ___.  Section 235A.15, subsection 2,
  1 50 paragraph d, Code Supplement 1997, is amended by
  2  1 adding the following new subparagraph:
  2  2    NEW SUBPARAGRAPH.  (6)  If authorized by a subject
  2  3 of a child abuse report as identified in paragraph
  2  4 "a", to a statewide elected official as defined in
  2  5 section 68B.2, a member of the general assembly, or a
  2  6 designee of a statewide elected official or member of
  2  7 the general assembly, to the maximum extent access to
  2  8 the information is available to any other person
  2  9 authorized under this lettered paragraph.  The purpose
  2 10 of the access shall be to monitor compliance of state
  2 11 agencies, officials, and employees with requirements
  2 12 under the law and the adequacy of the requirements.
  2 13 The authorization under this subparagraph shall
  2 14 encompass child abuse information which is subject to
  2 15 section 217.30 or 228.3 and relates to the person
  2 16 providing the authorization or to a child of the
  2 17 person.  The penalties applicable to violations of
  2 18 section 217.30 or 228.3 are applicable to unauthorized
  2 19 disclosures of information which are subject to
  2 20 section 217.30 or 228.3.
  2 21    Sec. ___.  Section 235A.19, subsection 2, paragraph
  2 22 b, Code Supplement 1997, is amended by adding the
  2 23 following new subparagraph:
  2 24    NEW SUBPARAGRAPH.  (8)  To a statewide elected
  2 25 official, a member of the general assembly, or a
  2 26 designee of a statewide elected official or member of
  2 27 the general assembly authorized under section 235A.15,
  2 28 subsection 2, paragraph "d".  The authorization under
  2 29 this subparagraph shall encompass child abuse
  2 30 information which is subject to section 217.30 or
  2 31 228.3 and relates to the person providing the
  2 32 authorization or to a child of the person.  The
  2 33 penalties applicable to violations of section 217.30
  2 34 or 228.3 are applicable to unauthorized disclosures of
  2 35 information which are subject to section 217.30 or
  2 36 228.3."
