1 3 #1. Page 20, by inserting after line 16 the
1 4 following:
1 5 "___. If approved by the federal government, adult
1 6 residential environments licensed as intermediate or
1 7 residential care facilities for persons with mental
1 8 retardation using a campus or village setting
1 9 approach, in not more than three counties, may convert
1 10 to a residential program under the provisions of a
1 11 medical assistance home and community-based services
1 12 waiver for persons with mental retardation, provided
1 13 the adult residential environments meet all of the
1 14 following requirements:
1 15 a. The intermediate or residential care facility
1 16 for persons with mental retardation license is
1 17 surrendered.
1 18 b. The environment's bed capacity is reduced by at
1 19 least twenty-five percent to a maximum capacity of no
1 20 more than twelve beds.
1 21 c. The environment submits a five-year plan for
1 22 further bed capacity reduction to the department of
1 23 human services and the plan is acceptable to the
1 24 department of human services.
1 25 The director of human services may authorize
1 26 reimbursement of the costs of environments converted
1 27 in accordance with this subsection from moneys
1 28 appropriated for state supplementary assistance at a
1 29 rate which does not exceed the maximum allowed for a
1 30 residential program under state supplementary
1 31 assistance requirements. The departments of human
1 32 services and inspections and appeals shall develop
1 33 standards and a monitoring process for environments
1 34 converted under this subsection. If the provisions of
1 35 this subsection are implemented, the department of
1 36 human services shall submit amendments to the general
1 37 assembly in accordance with section 2.16 to codify the
1 38 provisions."
