  1  1    Amend Senate File 2387 as passed by the Senate, as
  1  2 follows:
  1  3    #1.  Page 2, by inserting after line 20, the
  1  4 following:
  1  5    "Sec. ___.  NEW SECTION.  600.12A  DEATH OF PERSON
  1  6 TO BE ADOPTED – PROCESS FOR FINAL ADOPTION DECREE.
  1  7    1.  If the person to be adopted dies following the
  1  8 filing of an adoption petition pursuant to section
  1  9 600.3, but prior to issuance of a final adoption
  1 10 decree pursuant to section 600.13, the court may waive
  1 11 any investigations and reports required pursuant to
  1 12 section 600.8 that remain uncompleted, waive the
  1 13 minimum residence requirements pursuant to section
  1 14 600.10, proceed to the adoption hearing, and issue a
  1 15 final adoption decree, unless any person to whom
  1 16 notice is to be provided pursuant to section 600.11
  1 17 objects to the adoption.
  1 18    2.  A final adoption decree issued pursuant to this
  1 19 section terminates any parental rights existing prior
  1 20 to the time of its issuance and establishes the
  1 21 parent-child relationship between the adoption
  1 22 petitioner and the person adopted.  However, the final
  1 23 adoption decree does not confer any rights on the
  1 24 adoption petitioner to the estate of the adopted
  1 25 person and does not confer any rights on the adopted
  1 26 person to the estate of the adoption petitioner."
  1 27    #2.  Page 4, by inserting after line 7 the
  1 28 following:
  1 29    "Sec. ___.  PENDING PROCEEDINGS.  A termination of
  1 30 parental rights proceeding or an adoption proceeding
  1 31 pending on July 1, 1998, or a release of custody
  1 32 properly executed prior to July 1, 1998, shall not be
  1 33 affected by the provisions of this Act."
  1 34    #3.  By renumbering as necessary.
