1 1 Amend the amendment, H-8354, to House File 2494 as

1 3 #1. Page 2, by inserting after line 26 the
1 4 following:
1 5 "# . By striking page 29, line 34 through page
1 6 30, line 12, and inserting the following:
1 7 "3. a. A person required to be certified as a
1 8 commercial manure applicator must be certified by the
1 9 department each year. The person shall be certified
1 10 after completing an educational program which shall
1 11 consist of an examination required to be passed by the
1 12 person or three hours of continuing instructional
1 13 courses which the person must attend each year in lieu
1 14 of passing the examination.
1 15 b. A person required to be certified as a
1 16 confinement site manure applicator must be certified
1 17 by the department each three years. The person shall
1 18 be certified after completing an educational program
1 19 which shall consist of an examination required to be
1 20 passed by the person or two hours of continuing
1 21 instructional courses which the person must attend
1 22 each year in lieu of passing the examination.""
1 23 #2. Page 2, by inserting after line 50 the
1 24 following:
1 25 "The department may charge a fee for certifying
1 26 persons under this section. The fee for certification
1 27 shall be based on the costs of administering and
1 28 enforcing this section and paying the expenses of the
1 29 department relating to certification. The department
1 30 shall be reimbursed for all costs incurred. The
1 31 director shall set a fee for the examination which
1 32 shall be based upon the annual cost of administering
1 33 the examinations. All fees collected shall be
1 34 retained by the department for administration of the
1 35 certification program. However, a person required to
1 36 be certified as a commercial manure applicator shall
1 37 not be required to pay more than thirty dollars for
1 38 each certification, and a person required to be
1 39 certified as a confinement site manure applicator
1 40 shall not be required to pay more than fifteen dollars
1 41 for each certification.""
