1 1 Amend the amendment, H-8294 to House File 2517 as
1 2 follows:
1 3 #1. Page 1, line 26, by inserting after the word
1 4 "insurer" the following: "and shall include a
1 5 requirement, as specified by rules adopted by the
1 6 HAWK-I board, that a participating insurer, or
1 7 insurer's agent with a capitated payment system, shall
1 8 exercise ordinary care when making health care
1 9 treatment decisions and is liable for damages for harm
1 10 to an insured or enrollee proximately caused by the
1 11 participating insurer's failure to exercise such
1 12 ordinary care in a reasonable manner. As used in this
1 13 paragraph, "insurer's agent" means an employee, agent
1 14 or representative of a third-party payor who is acting
1 15 on behalf of the insurer and over whom the insurer has
1 16 the right to exercise influence or control".
