PAG LIN 1 1 Amend House File 2494 as follows: 1 2 #1. Page 5, line 5, by striking the word and figure 1 3 "subsection 1," and inserting the following: 1 4 "subsections 1 and 2". 1 5 #2. Page 5, line 5, by striking the word "is" and 1 6 inserting the following: "are". 1 7 #3. Page 5, by inserting after line 16 the 1 8 following: 1 9 "2.TheIf a county provides cleanup under section 1 10 204.5 after acquiring real estate following nonpayment 1 11 of taxes, the department shall determine if a claim is 1 12 eligible to be satisfied under thissection1 13 subsection, and do one of the following: 1 14 a. Pay the amount of the claim required in this 1 15 section, based on the fixed amount specified in the 1 16 bid submitted by the county upon completion of the 1 17 work. 1 18 b. Obtain a lower fixed amount bid for the work 1 19 from another qualified person, other than a 1 20 governmental entity, and pay the amount of the claim 1 21 required in this section, based on the fixed amount in 1 22 this bid upon completion of the work. The department 1 23 is not required to comply with section 18.6 in 1 24 implementing this section. 1 25 2A. If a county provides cleanup of a condition 1 26 causing a clear, present, and impending danger to the 1 27 public health or environment, as provided in section 1 28 204.5, the county may make a claim against the fund to 1 29 pay cleanup costs incurred by the county, according to 1 30 procedures and requirements established by rules 1 31 adopted by the department. The department shall 1 32 determine if a claim is eligible to be satisfied under 1 33 this subsection, and pay the amount of the claim 1 34 required in this section." 1 35 #4. Page 6, line 10, by striking the words "The 1 36 department" and inserting the following: "If the 1 37 department fails to provide cleanup within twenty-four 1 38 hours after being notified of a condition requiring 1 39 cleanup, the county may provide for the cleanup as 1 40 provided in this paragraph.
