1 1 Amend the Senate amendment, H-8119, to House File
1 2 299, as amended, passed, and reprinted by the House,
1 3 as follows:
1 4 #1. Page 15, by striking lines 24 through 37 and
1 5 inserting the following:
1 6 "16. REPORTS.
1 7 a. An employer who conducts a drug test pursuant
1 8 to this section shall, for each fiscal year beginning
1 9 on or after July 1, 1999, file an annual report with
1 10 the division of labor services of the department of
1 11 workforce development, on forms provided by the
1 12 division, documenting the number of accidents,
1 13 including the number of personal injuries and the
1 14 dollar loss for property damage arising out of the
1 15 accidents, caused by the use of drugs or alcohol by
1 16 employees and documenting separately for each category
1 17 of testing described in subsection 8 the following
1 18 information:
1 19 (1) The number of drug or alcohol tests conducted
1 20 in each category.
1 21 (2) The results of drug or alcohol tests conducted
1 22 in each category.
1 23 (3) The cumulative direct costs of drug or alcohol
1 24 tests in each category. Direct costs includes
1 25 employee work hours lost due to the conducting of drug
1 26 or alcohol testing pursuant to this section.
1 27 (4) The cost of substance abuse evaluation and
1 28 treatment for employees in each category.
1 29 b. The division of labor services of the
1 30 department of workforce development shall compile the
1 31 information submitted by employers pursuant to this
1 32 subsection and shall submit an annual report to the
1 33 general assembly on this information."
