1 2 #1. Page 1, line 32, by inserting before the words
1 3 "A person" the following: "Civil penalties collected
1 4 pursuant to this subsection shall be deposited into
1 5 the anhydrous ammonia equipment security fund created
1 6 in section 200.23."
1 7 #2. Page 2, by inserting after line 2, the
1 8 following:
1 9 "Sec. ___. NEW SECTION. 200.23 ANHYDROUS AMMONIA
1 10 EQUIPMENT SECURITY AND SITE CLEANUP FUND.
1 11 1. As used in this section, "alliance" means the
1 12 governor's alliance on substance abuse.
1 13 2. An anhydrous ammonia equipment security fund is
1 14 created in the state treasury under the control of the
1 15 head of the alliance. The fund is composed of any
1 16 moneys appropriated by the general assembly and of any
1 17 other moneys available to and obtained or accepted by
1 18 the alliance from the federal government or private
1 19 sources for placement in the fund. Civil penalties
1 20 collected for violations of section 200.14 shall be
1 21 deposited into the fund. Proceeds from forfeited
1 22 property shall be deposited into the fund as provided
1 23 in section 809A.17.
1 24 3. Moneys in the fund are subject to an annual
1 25 audit by the auditor of state. The fund is subject to
1 26 warrants written by the director of revenue and
1 27 finance, drawn upon the written requisition of the
1 28 head of the alliance.
1 29 4. Section 8.33 shall not apply to moneys in the
1 30 fund. Notwithstanding section 12C.7, moneys earned as
1 31 income, including as interest, from moneys in the fund
1 32 shall remain in the fund until expended as provided in
1 33 this section. The alliance shall not in any manner
1 34 directly or indirectly pledge the credit of the state.
1 35 5. Moneys in the fund shall be used for the
1 36 following purposes:
1 37 a. To assist owners of anhydrous ammonia equipment
1 38 in purchasing or installing devices necessary to
1 39 secure the equipment from intentional tampering,
1 40 including locks, lights, or fencing, according to
1 41 requirements established by the alliance in
1 42 cooperation with the department of public safety.
1 43 b. To reimburse counties for costs associated with
1 44 cleaning up clandestine laboratory sites as defined in
1 45 section 124C.1.
1 46 The moneys in the fund may be used on a cost-share
1 47 basis as determined practical by the alliance.
1 48 Sec. ___. Section 809A.17, subsection 5, Code
1 49 1997, is amended by adding the following new
1 50 paragraph:
2 1 NEW PARAGRAPH. e. Forfeited property used in
2 2 connection with a violation of section 200.14 shall be
2 3 deposited with the department of public safety to be
2 4 disposed of in accordance with the rules of the
2 5 department. However, the department shall distribute
2 6 not more than one thousand five hundred dollars per
2 7 forfeiture to the anhydrous ammonia equipment security
2 8 fund created pursuant to section 200.23. The
2 9 department may dispose of the property by a
2 10 commercially reasonable public sale in order to carry
2 11 out this paragraph."
2 12 #3. Title page, line 4, by inserting after the
2 13 word "ammonia," the following: "providing for the
2 14 allocation of moneys to support security needs and the
2 15 cleanup of clandestine laboratory sites,".
