If a business has received incentives or 2 2 assistance under section 15E.186 and fails to maintain 2 3 the requirements of subsection 1 to be an eligible 2 4 business, the business is subject to repayment of all 2 5 or a portion of the incentives and assistance that it 2 6 has received. The city or county, as applicable, 2 7 shall have the authority to take action to recover the 2 8 value of taxes not collected as a result of the 2 9 exemption provided by the community to the business. 2 10 The department of revenue and finance shall have the 2 11 authority to recover the value of state taxes or 2 12 incentives provided under section 15E.186. The value 2 13 of state incentives provided under section 15E.186 2 14 includes applicable interest and penalties. The 2 15 department of economic development and the city and 2 16 county, as applicable, shall enter into agreement with 2 17 the business specifying the method for determining the 2 18 amount of incentives or assistance paid which will be 2 19 repaid in the event of failure to maintain the 2 20 requirements of subsection 1. In addition, a business 2 21 that fails to maintain the requirements of subsection 2 22 1 shall not receive incentives or assistance for each 2 23 year during which the business is not in compliance." 2 24 #17.
