  1  1    Amend Senate File 40, as amended, passed, and
  1  2 reprinted by the Senate, as follows:
  1  3    #1.  Page 1, line 2, by striking the words "TO
  1  4 COMMIT A PUBLIC OFFENSE" and inserting the following:
  1  5 "BY PRIVATE PERSON TO STOP MOTOR VEHICLE".
  1  6    #2.  Page 1, by striking lines 3 through 7 and
  1  7 inserting the following:
  1  8    "1.  A private person who does not meet the
  1  9 requirements of section 804.9 for making an arrest
  1 10 commits a serious misdemeanor if the person uses an
  1 11 official law enforcement warning device or signal, or
  1 12 a device or signal that looks or sounds like an
  1 13 official law enforcement warning device or signal, for
  1 14 purposes of causing the operator of a motor vehicle to
  1 15 stop that motor vehicle."
  1 16    #3.  Title page, lines 2 and 3, by striking the
  1 17 words "in the attempt or commission of a public
  1 18 offense" and inserting the following:  "by private
  1 19 persons to unlawfully stop a motor vehicle".
