1 2 amended, passed, and reprinted by the Senate as
1 3 follows:
1 4 #1. Page 1, line 10, by striking the word
1 5 "unchanged."" and inserting the following:
1 6 "unchanged."
1 7 2. Page 1, by inserting after line 10, the
1 8 following:
1 9 "NEW PARAGRAPH. r. The conversion of an existing
1 10 number of beds by an intermediate care facility for
1 11 persons with mental retardation to a smaller facility
1 12 environment, including but not limited to a community-
1 13 based environment which does not result in an
1 14 increased number of beds, notwithstanding any
1 15 provision in this division to the contrary, including
1 16 subsection 4, if all of the following conditions
1 17 exist:
1 18 (1) The intermediate care facility for persons
1 19 with mental retardation reports the number and type of
1 20 beds to be converted on a form prescribed by the
1 21 department at least thirty days before the conversion.
1 22 (2) The intermediate care facility for persons
1 23 with mental retardation reports the conversion of beds
1 24 on its next annual report to the department."
