1 1 Amend the amendment, H-1673, to Senate File 472, as
1 2 amended, passed, and reprinted by the Senate, as
1 3 follows:
1 4 #1. Page 1, by inserting after line 49, the
1 5 following:
1 6 "___. A county board of supervisors may adopt an
1 7 ordinance pursuant to section 331.302 requiring a
1 8 person to submit security evidence of financial
1 9 responsibility with the county prior to constructing
1 10 an anaerobic lagoon or earthen manure storage basin
1 11 which is part of a confinement feeding operation. A
1 12 person shall not construct or expand an anaerobic
1 13 lagoon or earthen manure storage basin in violation of
1 14 the ordinance. The security evidence of financial
1 15 responsibility may be in the form of a bond, cash
1 16 deposit, or statement of net worth as required by the
1 17 board. The bond or cash deposit shall be for an
1 18 amount and be used for the exclusive purpose of
1 19 ensuring the cleanup of a site contaminated by manure
1 20 originating from the confinement feeding operation.
1 21 As used in this subsection, "bond" means a bond issued
1 22 by a surety company or an irrevocable letter of credit
1 23 issued by a financial institution as defined in
1 24 section 12.61."
