  1  1    Amend House File 693 as follows:
  1  2    #1.  Page 9, by inserting after line 15 the
  1  3 following:
  1  4    "Sec. ___.  NEW SECTION.  668B.1  LIMITATION ON
  1  5 NONECONOMIC DAMAGES.
  1  6    1.  In a civil action in which liability is
  1  7 admitted or established, the present value of the
  1  8 damages awarded for noneconomic losses incurred or to
  1  9 be incurred in the future by the plaintiff by reason
  1 10 of personal injury or death, shall not exceed two
  1 11 hundred fifty thousand dollars.  As used in this
  1 12 section, "noneconomic losses" shall include but not be
  1 13 limited to pain and suffering, mental anguish,
  1 14 emotional distress, humiliation, loss of consortium,
  1 15 lost opportunity, loss of expectations, and punitive
  1 16 or exemplary damages.
  1 17    2.  In an action tried to a jury where damages for
  1 18 noneconomic losses are sought, the court shall submit
  1 19 an instruction to the jury that the maximum allowable
  1 20 award allowed by law for noneconomic losses in a case
  1 21 of the most egregious nature is two hundred fifty
  1 22 thousand dollars and that the damages awarded in the
  1 23 case before them for noneconomic damages shall be made
  1 24 in proportion thereto based on the egregiousness of
  1 25 the loss if liability for such losses is established.
  1 26 A separate interrogatory verdict form shall be
  1 27 submitted for the return of noneconomic damages unless
  1 28 all parties waive this requirement."
