  1  1    Amend House File 708 as follows:
  1  2    #1.  Page 18, by inserting after line 23 the
  1  3 following:
  1  4    "Sec.    .  Section 335.2, Code 1997, is amended to
  1  5 read as follows:
  1  6    335.2  FARMS AGRICULTURAL PURPOSES EXEMPT.
  1  7    1.  As used in this section, "confinement swine
  1  8 feeding operation" means a confinement feeding
  1  9 operation as defined in section 455B.161 in which
  1 10 swine are confined and fed.
  1 11    2.  Except to the extent required to implement
  1 12 section 335.27, no as provided in this section, an
  1 13 ordinance adopted under this chapter applies shall not
  1 14 apply to an agricultural operation, including land,
  1 15 farm houses, farm barns, farm outbuildings, or other
  1 16 buildings or structures, which are primarily adapted,
  1 17 by reason of nature and area, for use for an
  1 18 agricultural purposes purpose, while so used.
  1 19 However, the ordinances an ordinance adopted under
  1 20 this chapter may apply to any of the following:
  1 21    a.  The implementation of an agricultural land
  1 22 preservation ordinance, as provided in section 335.27.
  1 23    b.  A structure, building, dam, obstruction,
  1 24 deposit, or excavation in or on the flood plains of
  1 25 any a river or stream.
  1 26    c.  A confinement swine feeding operation.
  1 27 However, an ordinance adopted under this chapter shall
  1 28 not apply to a confinement swine feeding operation, if
  1 29 any of the following are applicable:
  1 30    (1)  There are less than three thousand five
  1 31 hundred head of swine subject to care and feeding by
  1 32 the confinement swine feeding operation.
  1 33    (2)  The owner of the parcel of agricultural land
  1 34 where the confinement swine feeding operation is
  1 35 located is qualified to file for a homestead tax
  1 36 credit as provided pursuant to section 425.2 on that
  1 37 parcel."
