1 2 #1. Page 2, by striking lines 2 through 6 and
1 3 inserting the following: "environmental management
1 4 system or process. An environmental audit may be
1 5 conducted by the owner or operator of the facility, by
1 6 an employee of the owner or operator of the facility,
1 7 by an officer or director of the facility, by an
1 8 independent contractor of the facility provided the
1 9 person participating in the audit possesses a
1 10 knowledge of the facility and of the state
1 11 environmental requirements."
1 12 #2. Page 4, by striking line 9 and inserting the
1 13 following: "privilege under sections 455B.484A and
1 14 455H.4:".
1 15 #3. Page 7, by inserting after line 16 the
1 16 following:
1 17 "5. An employee who reports environmental
1 18 noncompliance and who is acting on the reasonable
1 19 belief of either of the following shall be exempt from
1 20 this section:
1 21 a. There was a willful or fraudulent attempt on
1 22 the part of the owner or operator to suppress evidence
1 23 of violations which harm public health or the
1 24 environment.
1 25 b. There were compliance actions which were not
1 26 being undertaken promptly, in good faith, or
1 27 competently, and such information was being
1 28 suppressed."
1 29 #4. Page 9, by striking lines 23 through 25 and
1 30 inserting the following: "disclosure."
1 31 #5. Page 9, line 32, by striking the word
1 32 "mitigate" and inserting the following: "consider
1 33 mitigating".
