1 8 #3. Page 2, line 25, by inserting after the word
1 9 "prepared" the following: "and certified in
1 10 accordance with rules of the department".
1 11 #4. Page 2, line 35, by inserting after the word
1 12 "updates" the following: "certified by the auditor in
1 13 accordance with rules of the department".
1 14 #5. Page 3, by inserting after line 11 the
1 15 following:
1 16 "Sec. ___. NEW SECTION. 455H.3A CERTIFICATION
1 17 AND REPORTING.
1 18 The department shall adopt rules providing for the
1 19 certification of independent environmental auditors,
1 20 certification of environmental audit reports and
1 21 updates by auditors, notification of audit
1 22 commencement by certified auditors, and filing of
1 23 summaries of audit reports and updates by certified
1 24 auditors. Notwithstanding any audit report privilege
1 25 provisions contained elsewhere in this chapter, the
1 26 rules shall require a certified auditor to file with
1 27 the department a notice of commencement of an audit, a
1 28 notice of completion of the audit, and a summary
1 29 report of the scope of the audit, including the
1 30 recommendations for corrective actions and practices
1 31 which were included in the audit report to improve
1 32 compliance with environmental laws. Each notice and
1 33 summary report shall include the identification of the
1 34 owner or operator and affected facilities."
1 35 #6. Page 3, line 26, by inserting before the word
1 36 "A" the following: "Eligibility of the owner or
1 37 operator for any benefit conferred by this chapter
1 38 shall be contingent on compliance with all
1 39 certification and reporting requirements imposed by
1 40 this chapter and rules which implement this chapter."
1 41 #7. By renumbering as necessary.
