1 2 #1. Page 115, line 24, by striking the word
1 3 "subsection" and inserting the following:
1 4 "subsections".
1 5 #2. Page 115, by inserting after line 27 the
1 6 following:
1 7 "NEW SUBSECTION. 8A. If a parent awarded joint
1 8 legal custody and physical care or sole legal custody
1 9 is relocating the residence of the minor child to
1 10 another state, the court shall modify the custody
1 11 order to preserve, as nearly as possible, the existing
1 12 relationship between the minor child and the
1 13 nonrelocating parent. If modified, the order shall,
1 14 at a minimum, include a provision for extended
1 15 visitation during summer vacations and school breaks
1 16 and scheduled telephone contact between the
1 17 nonrelocating parent and the minor child. The
1 18 modification may include a provision assigning the
1 19 responsibility for transportation of the minor child
1 20 for visitation purposes to either or both parents. If
1 21 the court makes a finding of past interference by the
1 22 parent awarded joint legal custody and physical care
1 23 or sole legal custody with the minor child's access to
1 24 the other parent, the court may order the posting of a
1 25 cash bond to assure future compliance with the
1 26 visitation provisions of the decree. The supreme
1 27 court shall prescribe guidelines for the forfeiting of
1 28 the bond and restoration of the bond following
1 29 forfeiting of the bond."
1 30 #3. Page 121, by inserting after line 25 the
1 31 following:
1 32 "Sec. . Section 598.23, subsection 2, Code
1 33 1997, is amended by adding the following new
1 34 paragraphs:
1 35 NEW PARAGRAPH. c. Directs the parties to provide
1 36 access to the child through a neutral party or neutral
1 37 site or center.
1 38 NEW PARAGRAPH. d. Imposes sanctions or specific
1 39 requirements or orders the parties to participate in
1 40 mediation to enforce the joint custody provisions of
1 41 the decree.
1 42 Sec. . Section 598.23, Code 1997, is amended by
1 43 adding the following new subsection:
1 44 NEW SUBSECTION. 3. In addition to the provisions
1 45 for punishment for contempt under this section, if the
1 46 court finds a person in contempt for failing to comply
1 47 with the visitation provisions of an order or decree
1 48 without good cause, the court may enjoin the contemnor
1 49 from engaging in the activity governed by a license to
1 50 operate a motor vehicle through suspension or
2 1 revocation of the license and may impose conditions
2 2 for reinstatement of the license."
