1 4 "Sec. ___. NEW SECTION. 50.50 ADMINISTRATIVE
1 5 RECOUNTS.
1 6 The commissioner who was responsible for conducting
1 7 an election may request an administrative recount when
1 8 the commissioner suspects that voting equipment used
1 9 in the election malfunctioned or that programming
1 10 errors may have affected the outcome of the election.
1 11 An administrative recount shall be conducted by the
1 12 board of the special precinct established by section
1 13 53.23. Bond shall not be required for an
1 14 administrative recount. The state commissioner may
1 15 adopt rules for administrative recounts.
1 16 If the recount board finds that there is an error
1 17 in the programming of any voting equipment which may
1 18 have affected the outcome of the election for any
1 19 office or public measure on the ballot, the recount
1 20 board shall describe the errors in its report to the
1 21 commissioner. The commissioner shall notify the board
1 22 of supervisors. The supervisors shall determine
1 23 whether to order an administrative recount for any or
1 24 all of the offices and public measures on the ballot."
