  1  1    Amend House File 612 as follows:
  1  2    #1.  Page 117, by inserting after line 24 the
  1  3 following:
  1  4    "Sec.    .  Section 598.21, Code 1997, is amended
  1  5 by adding the following new subsection:
  1  6    NEW SUBSECTION.  12.  If the court, in an action to
  1  7 overcome paternity pursuant to section 600B.41A,
  1  8 determines that the test results conducted in
  1  9 accordance with section 600B.41 or chapter 252F
  1 10 exclude the established father as the biological
  1 11 father, but the court dismisses the action to overcome
  1 12 paternity, the court shall modify any existing support
  1 13 order to discharge the established father from any and
  1 14 all support due prior to the date the order is filed,
  1 15 current support, and future support and shall order
  1 16 the mother to be solely liable for support of the
  1 17 child if all of the following apply:
  1 18    a.  The mother represented the established father
  1 19 as the biological father of the child in a court
  1 20 proceeding or in court documents.
  1 21    b.  The mother has testified that a possibility
  1 22 exists that the established father is not the
  1 23 biological father of the child.
  1 24    c.  Blood or genetic test results demonstrate that
  1 25 the established father is excluded as the biological
  1 26 father of the child.
  1 27    This section is applicable to any existing or
  1 28 future support order which is based upon a dismissal
  1 29 of an action to overcome paternity pursuant to section
  1 30 600B.41A and which meets all of the criteria of this
  1 31 subsection.
  1 32    Any costs associated with the modification action
  1 33 shall be paid by the mother.
