1 7 release of information by a school concerning the
1 8 child's compliance with attendance requirements."

1 11 court,".
1 12 #3. Page 2, line 33, by inserting after the word
1 13 "family." the following: "If more than one child in
1 14 the family is deemed to be truant, the sanction shall

1 16 written notification from the school truancy officer,
1 17 as provided in subsection 4, concerning each child."

1 23 implement protocols restricting information access
1 24 under this section by region or other means to provide
1 25 for the minimum access to information necessary to
1 26 implement the purposes of this section."

1 30 "In lieu of" the following: "a criminal".

1 33 finds that the parent, guardian, or legal or actual
1 34 custodian of the child has been subject to sanction
1 35 under section 239.5B as a result of the child's
1 36 truancy, the court may waive the civil penalty under
1 37 this section."
1 38 #9. Page 6, line 3, by striking the word "may" and
1 39 inserting the following: "shall".
1 40 #10. Page 6, by striking lines 15 through 17 and
1 41 inserting the following: "for family investment
1 42 program assistance."
1 43 #11. Page 6, line 17, by inserting after the
1 44 figure "279A.9A." the following: "Release of
1 45 information under this section shall be restricted to
1 46 the minimum access to information necessary to achieve
1 47 the purposes of this section."
1 48 #12. Page 6, by inserting after line 24 the
1 49 following:
1 50 "Sec. ___. EFFECTIVE DATE APPLICABILITY
2 1 EMERGENCY RULES CODE EDITOR.
2 2 1. a. Section 239.5B, as enacted by this Act,
2 3 being deemed of immediate importance, takes effect
2 4 upon enactment.
2 5 b. The department of human services shall begin
2 6 implementing the provisions of section 239.5B, as
2 7 enacted by this Act, which require written
2 8 authorization for release of information as a
2 9 condition of eligibility for family investment program
2 10 assistance, effective July 1, 1997, and shall complete
2 11 implementation not later than December 31, 1997.
2 12 c. The provisions of sections 239.5B and 299.12
2 13 authorizing information release or access between the
2 14 department of human services and school truancy
2 15 officers shall apply beginning January 1, 1998.
2 16 2. The department of human services may adopt
2 17 emergency rules under section 17A.4, subsection 2, and
2 18 section 17A.5, subsection 2, paragraph "b", to
2 19 implement the provisions of section 239.5B, as enacted
2 20 by this Act, in accordance with this section and the
2 21 rules shall be effective immediately upon filing,
2 22 unless the effective date is delayed by the
2 23 administrative rules review committee, notwithstanding
2 24 section 17A.4, subsection 5, and section 17A.8,
2 25 subsection 9, or a later effective date is specified
2 26 in the rules. Any rules adopted in accordance with
2 27 this subsection shall not take effect before the rules
2 28 are reviewed by the administrative rules review
2 29 committee. Any rules adopted in accordance with this
2 30 section shall also be published as a notice of
2 31 intended action as provided in section 17A.4.
2 32 3. If Senate File 516 or other legislation
2 33 providing for the repeal of chapters 239 and 249C and
2 34 codification of the family investment program in
2 35 chapter 239B is enacted by the Seventy-seventh General
2 36 Assembly, 1997 Session, the repeal of chapter 239
2 37 shall not be deemed to repeal section 239.5B, as
2 38 enacted by this Act, and the Code editor shall codify
2 39 section 239.5B, as enacted by this Act, as part of
2 40 chapter 239B and shall revise internal references to
2 41 that section necessary to conform with the designation
2 42 codified by the Code editor."
2 43 #13. Title page, lines 1 and 2, by striking the
2 44 words "and interagency efforts to address children's
2 45 problems".
2 46 #14. Title page, lines 3 and 4, by striking the
2 47 words "providing for interagency agreements,".
2 48 #15. Title page, line 5, by inserting after the
2 49 word "truancy" the following: ", applicability
2 50 provisions, and an effective date".
