  1  1    Amend House File 564 as follows:
  1  2    #1.  Page 1, line 1, by striking the words and
  1  3 figures "subsection 1, Code 1997, is" and inserting
  1  4 the following:  "subsections 1 and 3, Code 1997, are".
  1  5    #2.  Page 1, by inserting after line 9 the
  1  6 following:
  1  7    "3.  In its review of a proposal for
  1  8 reorganization, the board may shall consider all of
  1  9 the following:
  1 10    a.  Whether the board will have reasonable access
  1 11 to books, records, documents, and other information
  1 12 relating to the public utility or any of its
  1 13 affiliates.
  1 14    b.  Whether the public utility's ability to attract
  1 15 capital on reasonable terms, including the maintenance
  1 16 of a reasonable capital structure, is impaired.
  1 17    c.  Whether the ability of the public utility to
  1 18 provide safe, reasonable, and adequate service is
  1 19 impaired.
  1 20    d.  Whether ratepayers are detrimentally affected.
  1 21    e.  Whether the public interest is detrimentally
  1 22 affected.
  1 23    f.  Whether the reorganization will adversely
  1 24 impact competition in the market in this state for any
  1 25 gas or electric service.
  1 26    g.  Whether the reorganization will benefit the
  1 27 communities in the area served by the public utility,
  1 28 and will benefit the local and state economy with
  1 29 respect to, among other factors, job creation and
  1 30 retention.
  1 31    h.  Whether the reorganization will maintain and
  1 32 improve the ability of the state to protect and
  1 33 improve the environment, promote energy conservation,
  1 34 and require long-term resource planning by the public
  1 35 utility."
