1 4 "Sec. ___. NEW SECTION. 514B.13A PROHIBITED
1 5 CONDUCT.
1 6 1. A health maintenance organization shall not
1 7 prohibit a participating provider from or penalize a
1 8 participating provider for discussing treatment
1 9 options with covered persons, irrespective of the
1 10 health maintenance organization's position on the
1 11 treatment options, or from advocating on behalf of
1 12 covered persons within the utilization review or
1 13 grievance processes established by the health
1 14 maintenance organization or a person contracting with
1 15 the health maintenance organization.
1 16 2. A health maintenance organization shall not
1 17 penalize a provider because the provider, in good
1 18 faith, reports to state or federal authorities any act
1 19 or practice by the health maintenance organization
1 20 that, in the opinion of the provider, jeopardizes
1 21 patient health or welfare.
1 22 Sec. ___. NEW SECTION. 514F.4 PROHIBITED
1 23 CONDUCT.
1 24 1. A health care insurer shall not prohibit a
1 25 participating provider from or penalize a
1 26 participating provider for discussing treatment
1 27 options with covered persons, irrespective of the
1 28 health care insurer's position on the treatment
1 29 options, or from advocating on behalf of covered
1 30 persons within the utilization review or grievance
1 31 processes established by the health care insurer or a
1 32 person contracting with the health care insurer.
1 33 2. A health care insurer shall not penalize a
1 34 provider because the provider, in good faith, reports
1 35 to state or federal authorities any act or practice by
1 36 the health care insurer that, in the opinion of the
1 37 provider, jeopardizes patient health or welfare."
